Scholarship and subsidy recipients can complain if the selection process is illegal in Vietnam

Recently, the Ministry of Education and Training has issued Circular 35/2011/TT-BGDDT stipulating the awarding and receiving of scholarships and allowances for learners in educational institutions under the national education system in Vietnam.

Article 6 of Circular 35/2011/TT-BGDDT stipulates the rights of learners who receive scholarships and subsidies as follows:

- Be informed about scholarship and subsidy programs; express their legitimate aspirations and be treated equally in receiving scholarships and subsidies if they meet the program requirements;- Have the right to complain to the head of the educational institution, sponsors, or competent authorities if they find that the scholarship and subsidy selection process is not conformable.

In addition to the rights, learners receiving scholarships and subsidies have the following responsibilities:

- Be honest when registering to participate in the program;- Use the funding for the correct purposes; fulfill commitments with sponsors or educational institutions (if any); strive to study and train actively;- Report promptly to the head of the educational institution when sponsors have requests differing from the initial objectives of the received scholarships or subsidies.

In addition, Circular 35/2011/TT-BGDDT also stipulates the rights and responsibilities of scholarship and subsidy sponsors. To be specific as follows:

- Rights of the sponsor:

- Be facilitated in supporting learners for the purpose of developing educational careers;- Enjoy preferential policies stipulated in Circular No. 130/2008/TT-BTC dated December 26, 2008, by the Ministry of Finance guiding the implementation of some articles of the Enterprise Income Tax Law No. 14/2008/QH12 and guiding the implementation of Decree No. 124/2008/ND-CP dated December 11, 2008, by the Government of Vietnam detailing the implementation of some articles of the Enterprise Income Tax Law;- Be fully informed about the implementation of the scholarship and subsidy program;- Be ensured benefits according to the agreed written agreement with the scholarship and subsidy receiving unit in accordance with Vietnamese law.

- Responsibilities of the sponsor:

- Fulfill commitments in the written agreement with the scholarship and subsidy receiving unit;- Not arbitrarily add complicated procedures or forms of organization that are not consistent with the scale of the scholarship and subsidy and the cultural identity of Vietnam.
