Sanctions for Violations in the Management and Use of Identity Cards

Decree No. 167/2013/ND-CP stipulates administrative sanctions for activities violating regulations on the management and usage of ID cards as follows:

First, when there is a request to present, request to check, or if the usage of an ID card is overdue without compliance, the violator may be subject to a warning or a fine ranging from 100,000 VND to 200,000 VND. Specifically:

- Failing to present an ID card when requested by an authorized person;- Not complying with the law regarding the issuance, re-issuance, or renewal of an ID card;- Not complying with the law regarding the revocation or temporary retention of an ID card when requested by an authorized person.

Second, a fine ranging from 1,000,000 VND to 2,000,000 VND is imposed for any of the following acts:

- Using another person's ID card to perform activities that are against the law;- Erasing or modifying the ID card;- Renting, borrowing, or lending an ID card for the purpose of performing activities that are against the law.

Third, a fine ranging from 2,000,000 VND to 4,000,000 VND is imposed for any of the following acts:

- Providing false information, forging documents, or submitting false information to obtain an ID card;- Forging ID cards;- Using forged ID cards.

Fourth, a fine ranging from 4,000,000 VND to 6,000,000 VND is imposed for mortgaging ID cards in order to perform activities that are against the law.

In addition to the monetary fines mentioned above, individuals who erase, modify, or forge ID cards will have the offending objects and means of administrative violation confiscated; and fake ID cards will be subject to revocation.
