Salary for Working on New Year's Day January 1, 2018?

New Year's Day this year (January 01, 2018) falls on a Monday, so employees will have 3 days off (from December 30, 2017 to January 01, 2018). In the case that employees work or are on duty during this period, they will receive a higher wage than usual.

Article 115 of the Labor Code 2012 stipulates that employees are entitled to paid leave on public holidays and Tet holidays.

Article 97 of the Labor Code 2012 regulates the overtime pay rates and night work pay.

An employee working on public holidays will receive a salary of at least 300% of their normal wages (excluding the salary for holidays and paid leave for employees on a salaried day).

Thus, the total salary for an employee working overtime or on duty on the Gregorian New Year is 400% of the normal daily wage.

- If an employee works at night:

Night work salary = Hourly wage of a normal working day x 300% + Hourly wage of a normal working day x Minimum 30% x Number of night working hours

- If an employee works overtime at night:

Overtime night work salary = Hourly wage of a normal working day x 300% + Hourly wage of a normal working day x Minimum 30% + 20% x Hourly wage of a public holiday, Tet holiday, or paid leave day x Number of overtime night working hours.
