According to legal regulations, employees working on holidays in Vietnam are entitled to a salary of at least 300%, excluding the paid holiday salary for employees who receive daily wages. If a holiday coincides with a weekly day off, employees are entitled to compensatory leave on the following day.
This year, the Hung Kings’ Commemoration Day (March 10) falls on April 6 (Thursday) of the Solar Calendar. According to Official Dispatch 5039/BNV-TCCB on the occasion of the Hung Kings’ Commemoration Day 2017, employees in Vietnam will have a continuous 4-day vacation from April 6, 2017, to the end of April 9, 2017, and will make up for it on April 15, 2017. However, the leaders of the Department of Labor Safety (Ministry of Labor - War Invalids and Social Affairs) have corrected this information and issued an official decision stating that this year, only one day off will be observed for the Hung Kings’ Commemoration Day.
Regarding salaries:
According to the provisions at Point dd Clause 1 Article 115 of the Labor Code, employees will have a day off with full pay on April 6, 2017.
If employees work on April 6, 2017, the salary will be at least 300% excluding the salary for the holiday or paid leave for employees earning daily salarys. Hence, the total salary received will be 400% of the regular daily salary.
Regarding bonuses:
Clause 1 Article 103 of the Labor Code 2012 stipulates that a bonus is the amount of money the employer rewards the employee based on the annual business results and the level of work completion by the employee. Therefore, this is not a mandatory amount but depends on the employer's decision based on the business performance of the company.
