On November 15, 2024, the Government of Vietnam issued Decree 149/2024/ND-CP guiding the Law on Management and Use of Weapons, Explosives, and Supporting Tools 2024.
According to the provisions of Article 7 Decree 149/2024/ND-CP, safety measures in production, business, export, import, transportation, and use of high-lethality knives include:
- Organizations, businesses, and individuals producing, trading, exporting, importing, and transporting high-lethality knives must comply with the following regulations:
+ When manufacturing high-lethality knives, it is required to label, engrave a brand, symbol, or the name of the production facility on the product; the production process must be strictly managed, ensuring fire prevention and environmental protection; high-lethality knife products must be tightly wrapped, packed, or boxed;
+ Selling or displaying high-lethality knife products at fixed locations must be stored in cabinets, trays, or shelves; for non-fixed location sales, the knives must be tightly wrapped, packed, or stored, and secured carefully and safely;
+ Export and import of high-lethality knives must comply with commercial laws; the products must have a clear origin, be labeled, or have the name of the production facility;
+ During the transportation of high-lethality knives for business, export, or import, they must be packed, boxed, and securely tied to ensure they do not fall, get lost, or misplaced during transit;
+ In the event of loss or misplacement during production, business, export, import, or transportation of high-lethality knives, organizations, businesses, and individuals must notify the nearest police authority.
- Individuals transporting or carrying high-lethality knives for labor, production, or living purposes must wrap, store, and manage them safely; bringing high-lethality knives into public places requires them to be securely wrapped, stored, and guarded; their use must be tightly managed to prevent others from misusing them for illegal purposes.
- Organizations, businesses, and individuals involved in the production, business, export, import, transportation, or use of high-lethality knives must comply with the contents specified in clauses 1 and 2, Article 7 Decree 149/2024/ND-CP.
For further information, refer to Decree 149/2024/ND-CP, effective from January 1, 2025, except for the following provisions:
- Provisions of Article 9, Article 10, and Article 11 of Decree 149/2024/ND-CP take effect from July 1, 2025; provisions of Article 7 Decree 149/2024/ND-CP take effect from January 1, 2026.
Decree 79/2018/ND-CP of the Government of Vietnam, specifying details on the implementation of some articles and measures of the Law on Management and Use of Weapons, Explosives and Supporting Tools 2017, shall cease to be effective from the date Decree 149/2024/ND-CP takes effect, except for the provisions of Article 7, Article 8, Article 9, Article 10, and Article 11, which continue to be effective until June 30, 2025.
