From December 1, 2018, foreign employees working in Vietnam are subject to mandatory social insurance if they have a work permit or a practicing certificate or a practicing license issued by Vietnamese competent authorities, and have an indefinite-term employment contract or a definite-term employment contract of at least one year with an employer in Vietnam.
Foreign employees eligible for social insurance participation shall follow the mandatory social insurance policies and enjoy the benefits according to the schedule specified in Decree 143/2018/ND-CP. To be specific:
From December 1, 2018 | ♦ Sick leave benefits: Implemented according to the provisions of Articles 25 to 29 of the Law on Social Insurance 2014; ♦ Maternity benefits: Implemented according to the provisions of Articles 31 to 41 of the Law on Social Insurance 2014 and Articles 3, 4 of Decree 115/2015/ND-CP. ♦ Occupational accident and disease benefits: Implemented according to the provisions of Articles 45 to 54 of the Law on Occupational Safety and Hygiene and Decree 37/2016/ND-CP. |
From January 1, 2022, additional benefits: |
♦ Retirement benefits: Implemented according to the provisions of Articles 54, 56, 58, 59, 60, 62, 63, 64 of the Law on Social Insurance 2014 and Article 10 of Decree 115/2015/ND-CP. ♦ Survivorship benefits: Implemented according to the provisions of Articles 66 to 70 of the Law on Social Insurance 2014; ♦ One-time social insurance benefits: Implemented according to Clause 6, Article 9, Decree 143/2018/ND-CP. |
