On February 29, 2024, the Prime Minister of Vietnam issued Decision 209/QD-TTg approving the plan to simplify regulations related to business activities under the Ministry of Industry and Trade in 2024.

Roadmap for simplifying procedures related to chemical business activities in Vietnam

(1) 1st Administrative procedure: Procedures for granting DOC and DOC-PSF chemical production licenses (administrative procedure code 1.004015)

* Content of reduction and simplification:

Annul the procedure for granting DOC and DOC-PSF chemical production licenses.

Reason: The Chemical Weapons Convention does not require strict control measures for DOC and DOC-PSF chemicals as it does for Schedule chemicals. In addition, the abolition of this procedure aims to implement the government's policy of reducing investment and business conditions and simplifying administrative procedures, reducing the number of subjects required to perform administrative procedures.

* Implementation recommendations:

- Annul Article 20 of Decree 38/2014/ND-CP on the management of controlled chemicals under the Chemical Weapons Convention.

- Annul: Circular 55/2014/TT-BCT detailing and guiding the implementation of some provisions of Decree 38/2014/ND-CP on the management of controlled chemicals under the Chemical Weapons Convention; Circular 48/2018/TT-BCT amending some provisions of Circular 55/2014/TT-BCT; and Articles 3 and 4 of Circular 13/2020/TT-BCT amending, supplementing, and Annuling some regulations on investment conditions in the state management sector of the Ministry of Industry and Trade.

- Roadmap: Year 2024.

(2) 2nd Administrative procedure: Procedures for reissuing DOC and DOC-PSF chemical production licenses (administrative procedure code 2.001689)

* Content of reduction and simplification:

Annul the procedure for reissuing DOC and DOC-PSF chemical production licenses.

Reason: The Chemical Weapons Convention does not require strict control measures for DOC and DOC-PSF chemicals as it does for Schedule chemicals. In addition, the abolition of this procedure aims to implement the government's policy of reducing investment and business conditions and simplifying administrative procedures, reducing the number of subjects required to perform administrative procedures.

* Implementation recommendations:

- Annul Article 20 of Decree 38/2014/ND-CP on the management of controlled chemicals under the Chemical Weapons Convention.

- Annul: Circular 55/2014/TT-BCT; Circular 48/2018/TT-BCT; and Articles 3 and 4 of Circular 13/2020/TT-BCT.

(3) 3rd Administrative procedure: Procedures for Adjusting DOC and DOC-PSF chemical production licenses (administrative procedure code 1.003905)

* Content of reduction and simplification:

Annul the procedure for reissuing DOC and DOC-PSF chemical production licenses.

Reason: The Chemical Weapons Convention does not require strict control measures for DOC and DOC-PSF chemicals as it does for Schedule chemicals. In addition, the abolition of this procedure aims to implement the government's policy of reducing investment and business conditions and simplifying administrative procedures, reducing the number of subjects required to perform administrative procedures.
