Rights of social insurance participants and beneficiaries in Vietnam from July 1, 2024

On June 29, 2024, the National Assembly of Vietnam passed the Law on Social Insurance 2024 which takes effect from July 1, 2024. The rights of social insurance participants and beneficiaries in Vietnam are stipulated in Article 10 of the Law on Social Insurance 2024 as follows:

(1) Participants in social insurance have the following rights:

- Enjoy social insurance benefits according to the provisions of the Law on Social Insurance 2024;

- Be issued a social insurance book;

- Be provided with information about the payment of social insurance premiums through electronic means by the social insurance agency on a monthly basis; have the information on the payment of social insurance premiums verified by the social insurance agency upon request;

- Request the employer and related agencies and organizations to fully fulfill their responsibilities regarding social insurance in accordance with the law;

- Be informed and disseminated policies and laws on social insurance;

- Proactively undergo medical examination to assess the reduction in labor capacity if they are in the case of preserving the social insurance payment period and have the medical examination fee paid when the medical examination results meet the conditions to enjoy social insurance benefits according to the provisions of the Law on Social Insurance 2024;

- File complaints, denunciations, and lawsuits regarding social insurance in accordance with the law.

(2) Beneficiaries of social insurance benefits have the following rights:

- Receive full, prompt, and convenient social insurance benefits;

- Enjoy health insurance while receiving pensions; on leave while receiving monthly labor accident or occupational disease allowances; during maternity leave from 14 working days or more in a month; during sick leave from 14 working days or more in a month or on sick leave allowance for employees suffering from long-term treatment illnesses listed by the Minister of Health; while enjoying policies stipulated in Article 23 of the Law on Social Insurance 2024;

- Have the medical examination fee paid if not introduced by the employer for medical examination to assess the reduction in labor capacity where the medical examination results meet the conditions to enjoy social insurance benefits according to the provisions of the Law on Social Insurance 2024;

- Authorize in writing another person to perform social insurance procedures. In the case of authorizing to receive pensions, social insurance allowances, and other policies according to this Law, the authorization document is valid for a maximum of 12 months from the date of authorization. The authorization document must be authenticated in accordance with the law on authentication;

- For those aged 80 or older, if desired, the social insurance agency or service organization authorized by the social insurance agency will make pension and social insurance allowance payments at the place of residence within the territory of Vietnam;

- Be provided monthly with information on enjoying social insurance benefits through electronic means by the social insurance agency; have the information on enjoying social insurance benefits verified by the social insurance agency upon request;

- File complaints, denunciations, and lawsuits regarding social insurance in accordance with the law;

- Refuse to enjoy social insurance benefits.
