Recently, the Ministry of Public Security of Vietnam has issued the Circular No. 11/2019/TT-BCA stipulating speech and provision of information to the press of People’s Public Security, effective from July 01, 2019.
According to Article 8 of the Circular No. 11/2019/TT-BCA of the Ministry of Public Security of Vietnam, rights and responsibilities of the Spokesperson of the Ministry of Public Security, the authorized spokesperson of the Ministry of Public Security are specified as follows:
- The Spokesperson of the Ministry of Public Security, the authorized spokesperson of the Ministry of Public Security have the right to speak on behalf of and represent the Ministry of Public Security and provide information to the press.
- The Spokesperson of the Ministry of Public Security, the authorized spokesperson of the Ministry of Public Security have the right to request relevant units and individuals under the Ministry of Public Security to provide information, gather information for speech and provide information periodically and irregularly according to the provisions of Circular No. 11/2019/TT-BCA; to respond to reflections, recommendations, criticisms, complaints and denunciations of organizations or citizens transferred by the press agency or published or broadcast in the press in accordance with law.
Relevant units and individuals of the Ministry of Public Security at the request of the Spokesperson of the Ministry of Public Security, the person authorized to speak for the Ministry of Public Security regarding the provision of information to make statements and provide information to the press, shall be responsible for strictly complying with the requirements on content and time limit for providing information.
- The Spokesperson of the Ministry of Public Security, the authorized spokesperson of the Ministry of Public Security have the right to refuse to speak and not provide information to the press in cases specified in Clause 2 Article 38 of the Press Law 2016 of Vietnam.
- The Spokesperson of the Ministry of Public Security, the authorized spokesperson of the Ministry of Public Security are responsible before the law, before the Minister of Public Security for the content of statements and information provided to the press.
Notably, according to Clause 5 Article 8 of the Circular No. 11/2019/TT-BCA of the Ministry of Public Security of Vietnam, when there are grounds to believe that the press agencies incorrectly publish or broadcast the information they have provided, the Spokesperson of the Ministry of Public Security, the authorized spokesperson of the Ministry of Public Security have the right to give written feedback to the press agency, press management agency, state management agency in charge of the press or initiate a lawsuit at the Court.
