On September 4, 2020, the Ministry of Labor, Invalids and Social Affairs submitted the Draft Decree stipulating the National Database to the Government of Vietnam. The draft is currently under review and open for public comments.
Rights and responsibilities in exploiting and updating the National Insurance Database of Vietnam (Illustrative Photo)
Article 5 of the Draft Decree clearly stipulates the rights and responsibilities of organizations and individuals in exploiting and updating the National Insurance Database of Vietnam as follows:
Organizations and individuals exploiting and updating the National Insurance Database of Vietnam have the rights to:
- Access and exploit data about themselves or data they have created and updated into the National Insurance Database of Vietnam unless otherwise stipulated by law.- Reflect and propose to competent authorities regarding the content of data in the National Insurance Database of Vietnam.- Use their information and data in the National Insurance Database of Vietnam to submit or send to agencies, organizations, or individuals upon request when performing administrative procedures or social activities.- Receive instructions on how to exploit and interact with the National Insurance Database of Vietnam.
Organizations and individuals exploiting and updating the National Insurance Database of Vietnam have the responsibilities to:
- Be responsible for the accuracy of the information provided for updating into the National Insurance Database of Vietnam.- Fully comply with the provisions and instructions of competent authorities when exploiting from the National Database or providing information to be updated into the National Insurance Database of Vietnam.- Be legally responsible for violations of the provisions of this Decree and related laws.
Additionally, the draft decree stipulates the prohibitions in the construction, collection, updating, maintenance, management, exploitation, and use of the National Insurance Database of Vietnam as follows:
