Rights and obligations of social network service users in Vietnam from December 25, 2024

Article 36 of Decree 147/2024/ND-CP stipulates the rights and responsibilities of social network service users from December 25, 2024, as follows:

Social network service users (including organizations and individuals) in Vietnam have the following rights and responsibilities:

(1) To use social network services as prescribed by law.

(2) To have the user's information protected as prescribed by law, except in cases required by investigative agencies, or competent authorities for handling legal violations.

(3) To comply with the regulations on management, provision, and use of social network services.

(4) To be responsible for the content of information stored, provided, or transmitted on social networks, including disseminating information via links directly established by themselves.

(5) Accounts, content channels, community pages, and community groups on social networks have the right to register with the Ministry of Information and Communications (Department of Broadcasting, Television, and Electronic Information) to be trained and informed about legal provisions on internet service provision and use, and to receive advertising recommendations.

(6) To comply with specialized laws when providing specialized information and services on social networks; to comply with laws regarding taxation and payment for business, transactional activities on social networks.

(7) The account holder, content channel owner, community page owner, or community group administrator on social networks shall not name their account, page, channel, or group in a way that is similar to or identical to the name of a press agency or contains words (in Vietnamese or any equivalent foreign language) that might cause confusion as a press agency or journalism activities such as: Newspaper, radio, magazine, news, broadcasting, television, communication, press agency, etc.; must be responsible for managing content posted on their account, community page, group, or content channel;

They have the responsibility to block and remove illegal information, information affecting the rights and legitimate interests of other organizations or individuals, information affecting children posted on their account, community page, group, or content channel (including user comments) within 24 hours upon request by phone, in writing, or via electronic means from the Ministry of Information and Communications (Department of Broadcasting, Television, and Electronic Information), the Ministry of Public Security (Cybersecurity and High-Tech Crime Prevention Department), local Departments of Information and Communications, and other competent authorities according to specialized laws or within 48 hours for valid complaints from service users; not to exploit social networks to produce content in the form of reporting, investigation, press interviews.

(8) Accounts, community pages, content channels, and community groups on social networks when providing information via livestream features must comply with the regulations of this Decree. In cases related to providing other specialized services, they must adhere to relevant specialized laws.
