Rights and obligations of passenger auto transport businesses in Vietnam from 2025 (Internet image)
On June 27, 2024, the National Assembly officially passed the Law on road 2024, with many new regulations applied in the field of road traffic.
Pursuant to Article 58 of the Law on road 2024, the rights and obligations of passenger transport businesses by automobile are regulated as follows:
- Passenger transport businesses by automobile have the following rights:
+ Collect transport fees;
+ Refuse to transport passengers who cause public disorder on the automobile, obstruct the operations of the passenger transport business unit by automobile, affect the life, health, property of others, commit ticket fraud;
+ Decide preferential policies to serve customers and expand the business market.
- passenger transport businesses by automobile have the following obligations:
+ Comply and fully implement regulations on business, conditions for passenger transport by automobile, commitments on transport quality, transport contracts;
+ Purchase insurance for passengers; insurance fees are included in the ticket price, value of the transport contract;
+ Declare prices according to legal regulations on prices; provide tickets, transport fee receipts;
+ Compensate for damages caused by employees or representatives of the passenger transport business unit by automobile during the transport process as per legal regulations;
+ Implement ticket price reductions for the elderly, disabled persons, and other policy subjects as stipulated by law;
+ Do not allow organizations or individuals without a passenger transport business license by automobile to operate vehicles and determine transport prices on behalf of passengers;
+ Do not use individuals without a driving license or with a driving license not appropriate for the vehicle type, whose driving license has been deducted all points, or who is being suspended or revoked from driving a passenger transport vehicle.
Rights and Obligations of Drivers and Service Employees on Passenger Transport Business Automobiles in Vietnam
- Refuse to transport passengers who have one of the following behaviors:
+ Cause public disorder on the automobile;
+ Obstruct the work of drivers or service employees on the automobile;
+ Affect the life, health, or property of others on the automobile;
+ Commit ticket fraud;
+ Violate the provisions of point c, clause 2, Article 60 of the Law on road 2024.
- Refuse to operate the vehicle if it's found not meeting safety conditions as per legal regulations on road traffic order and safety.
- Do not refuse to transport passengers, except for reasons specified in clause 1, Article 59 of the Law on road 2024; do not cause difficulties for passengers who are elderly, disabled, children, or pregnant women; do not transfer passengers to another vehicle without their consent, except in force majeure cases.
- Collect transport fees according to listed prices or transport contracts.
- Exhibit civilized and polite behavior, speech, and actions; guide passengers to sit in designated places, prioritize seating for the elderly, disabled persons, children, and pregnant women.
- Fulfill responsibilities as stipulated by the legal regulations on road traffic order and safety and other related laws.

More details can be found in the Law on road 2024, which comes into force in Vietnam from January 1, 2025, except for points a and b, clause 2, Article 42, Article 43, Article 50, clause 1, Article 84 of the Law on road 2024, effective from October 1, 2024.
