Rights and obligations of individuals awarded the titles “People's Artist” and “Meritorious Artist” in Vietnam

Recently, the Government of Vietnam has issued regulations on awarding the titles “People's Artist” and “Meritorious Artist” in Vietnam.

Regarding this matter, LawNet clarifies as follows:

On June 6, 2024, the Government of Vietnam promulgated Decree No. 61/2024/ND-CP on awarding the titles "People’s Artist" and "Meritorious Artist".

Article 6 of Decree No. 61/2024/ND-CP specifies the rights and obligations of individuals awarded the titles "People’s Artist" and "Meritorious Artist" as follows:

- Individuals receive a Badge, Certificate of Recognition from the President, a monetary reward, and other benefits as prescribed by law.

- Individuals are obliged to preserve the awarded artifacts; continue to creatively contribute to culture and art to produce many valuable films, programs, plays, performances, and culture and art works for the public.

Principles of awarding the titles "People’s Artist" and "Meritorious Artist" in Vietnam

The awarding process is conducted according to the following principles:

- Accuracy, publicity, transparency, fairness, and promptness;

- Ensuring consistency between the form, subject of the reward, and the merits, achievements obtained;

- One form of reward may be given multiple times to an individual; however, the same achievement should not be rewarded multiple times in various forms; rewards should align with the achievements;

- Councils at various levels are only allowed to submit cases that meet the conditions, standards, procedures, and records stipulated in this Decree to higher authorities for consideration.

- The titles "People’s Artist" and "Meritorious Artist" are not awarded to co-authors of musical works and photographic works.

Time for awarding, announcing, and organizing the Ceremony for the titles "People’s Artist" and "Meritorious Artist" in Vietnam

- The titles "People’s Artist" and "Meritorious Artist" are awarded and announced every three years on the occasion of the National Day of the Socialist Republic of Vietnam.

- The Ministry of Culture, Sports, and Tourism organizes the awarding ceremony for the titles "People’s Artist" and "Meritorious Artist".

Subjects eligible for the titles "People’s Artist" and "Meritorious Artist" in Vietnam

Subjects eligible for the titles "People’s Artist" and "Meritorious Artist" are defined in Article 2 of Decree No. 61/2024/ND-CP as follows:

(1) Individuals engaged in cultural and artistic activities in public culture and art units;

(2) Individuals engaged in cultural and artistic activities in non-public culture and art units;

(3) Individuals who are teaching or managing in the field of culture and art but still participate in professional cultural and artistic performances;

(4) Individuals engaged in freelance professional cultural and artistic activities;

(5) Individuals engaged in the creation of cultural and artistic works;

(6) Organizations and individuals related to the awarding of the titles "People’s Artist" and "Meritorious Artist."

The individuals defined in clauses (1), (2), (3), (4), and (5) include:

- Actors: singers, dancers, musicians, poets; actors in traditional genres: Tuong, cheo, cai luong, folk drama, spoken drama, physical theatre, opera, ballet, circus, puppetry; film actors; television actors;

- Directors of comprehensive art programs of singing, dancing, and music; directors of traditional genres: Tuong, cheo, cai luong, folk drama, spoken drama, physical theatre, opera, ballet, circus, puppetry; film directors, television directors of various film genres: Feature films, documentaries, scientific films, animated films and mixed media films; radio theatre directors; television theatre directors;

- Sound designers (sound directors) in film and television works; sound designers in stage works; lighting designers for stage and comprehensive art programs;

- Choreographers; orchestra conductors; choir conductors; symphony ballet conductors; art directors;

- Cinematographers (cinematography directors) for film and television in various genres: Feature films, documentaries, scientific films, animated films, and mixed media films;

- Puppet artists; visual artists, performing animated film artists; stage design artists; film and television design artists; makeup artists, costume designers for stage, film, and television;

- Broadcasters in radio and television operating in the cultural and art field;

- Music composers, photographers.
