On June 26, 2024, the People's Committee of Ho Chi Minh City, Vietnam issued Decision 36/2024/QĐ-UBND on the classification, collection, transportation, and treatment of bulky solid waste in the city.

This regulation details the classification, collection, transportation, and treatment of bulky solid waste, the responsibilities, and authorities of organizations and individuals related to the management of bulky solid waste in HCMC.

This regulation does not apply to the management of industrial solid waste, construction waste, and hazardous waste.

It applies to agencies, units, organizations, individuals, and households involved in the activities of classifying, collecting, transporting, and handling bulky solid waste in HCMC.

In this regulation, the terms "Waste Source Owner," "Bulky Solid Waste," and "Household Waste Gathering Point" follow the guidelines of the Ministry of Natural Resources and Environment as specified in Article 3 of Circular 02/2022/TT-BTNMT.

Bulky solid waste classification involves dismantling, compacting, reducing the size and volume of bulky solid waste, and separating recyclable, reusable materials from those needing disposal according to the Ministry of Natural Resources and Environment's guidelines.

Bulky Solid Waste List: The list of bulky solid waste follows the Ministry of Natural Resources and Environment's guidelines on other household solid waste as per point c Clause 1 Article 75 of the Environmental Protection Law 2020.

Rights and obligations of entities generating bulky solid waste in Ho Chi Minh City, Vietnam

(1) Rights

  • Be guaranteed by the state to provide collection, transportation, and treatment services for bulky solid waste upon full payment of service fees as prescribed.

  • Have the option to transfer to recycling or reuse units for bulky solid waste or negotiate service contracts with authorized units for the collection, transportation, and treatment of household solid waste as per regulations.

  • Suggest to the district People's Committee and commune People's Committee on issues related to contract service pricing, and evaluate the quality of services provided for the collection, transportation, and treatment of bulky solid waste in the area.

(2) Obligations

  • Classify and transfer bulky solid waste as per this Regulation.

  • Store, preserve, and not deposit them on sidewalks, streets, or public areas while awaiting collection, transportation to gathering points, treatment facilities, recycling, or reuse units.

  • Be responsible for dismantling, and transporting their own bulky solid waste to a household waste gathering point, transfer station, or treatment facility if collection and transportation are refused due to non-compliance with classification regulations or non-agreement on service fees; any infringement causing unsanitary conditions, aesthetic disruptions in public areas, traffic obstructions, or affecting others will be subject to legal penalties.

  • Pay service fees for dismantling, collection, transportation, and treatment per the agreement, contract, and according to the regulations of the City People's Committee with the collection, transportation unit to the gathering point, transfer station, or treatment facility.

(3) Household-generated bulky solid waste is supported by the state budget for transportation and treatment according to Household Solid Waste Management regulations.
