Law on road traffic order and safety 2024 was passed by the National Assembly of Vietnam on June 27, 2024.

Rights and obligations of auction winner of license plate in Vietnam from January 1, 2025

In Article 38 of the Law on road traffic order and safety 2024 stipulates the rights and obligations of auction winner of license plate from January 1, 2025, as follows:

(1) Regarding rights

Auction winner of license plate have the following rights:

- To be granted a decision confirming the auction-winning number plate after paying the full auction-winning amount;

- To register the auction-winning number plate attached to their own vehicle at the police authority managing the auction-winning number plate or where the individual’s residence, temporary residence, or the auction-winning organization’s headquarters is located;

- To transfer, exchange, gift, or bequeath the vehicle with the auction-winning number plate;

- In case the auction winner dies within 30 days from the date of notification of the auction result and has not yet been granted a decision confirming the auction-winning number plate, the auction result will be canceled, and the legal heir according to the inheritance law shall receive the full auction-winning amount that the auction winner has paid;

- Within 12 months from the date of being granted the decision confirming the auction-winning number plate, if the auction winner dies but has not yet completed the vehicle registration procedure to attach the auction-winning number plate, the auction result will be canceled, and the legal heir according to the inheritance law shall receive the full auction-winning amount that the auction winner has paid.

(2) Regarding obligations

auction winner of license plate have the following obligations:

- To pay the full auction-winning amount within 30 days from the date of notification of the auction result; the auction amount does not include the registration fee and number plate issuance fee. After the specified period, if the auction winner of the number plate does not pay or pays insufficiently, the auction-winning number plate shall be re-auctioned or entered into the vehicle registration and management system, and the auction winner will not be refunded the deposit, or the amount paid, and will not be allowed to participate in vehicle number plate auctions for 12 months from the date of notification of the auction result;

- To complete the vehicle registration procedure to attach the auction-winning number plate within 12 months from the date of being granted the decision confirming the auction-winning number plate; in case of force majeure or objective obstacles, this period can be extended but not exceeding 06 months.

After the specified period, if the auction winner does not complete the vehicle registration procedure to attach the auction-winning number plate, the auction-winning number plate shall be re-auctioned or entered into the vehicle registration and management system, and the auction winner will not be refunded the auction amount paid;

- Not to transfer, exchange, gift, or bequeath the auction-winning number plate, except as specified at point c, clause 1, Article 38 of the Law on road traffic order and safety 2024.

Refer to the Law on road traffic order and safety 2024 which takes effect in Vietnam from January 1, 2025, except clause 3, Article 10 of the Law on road traffic order and safety 2024 taking effect in Vietnam from January 1, 2026.

Resolution 73/2022/QH15 of the National Assembly on the pilot auction of car license plates ceases to be effective from the date the Law on road traffic order and safety 2024 takes effect, except as specified in clause 7, Article 89 of the Law on road traffic order and safety 2024.

To be specific: The auction of car license plates conducted before the Law on road traffic order and safety 2024 takes effect and has been granted a document confirming the auction-winning automobile number plate by the effective date of the Law on road traffic order and safety 2024, shall continue to be implemented according to Resolution 73/2022/QH15 of the National Assembly on the pilot auction of car license plates; in case of not being granted a confirmation of the auction-winning automobile number plate, it shall continue to be implemented according to Resolution 73/2022/QH15 of the National Assembly on the pilot auction of car license plates and the provisions at point d, clause 1, Article 38 of the Law on road traffic order and safety 2024.
