On February 23, 2018, the Government of Vietnam issued Decree 22/2018/ND-CP detailing certain provisions related to copyright and related rights. Notably, there are regulations regarding the annulment of the certificate of copyright registration and related rights.
Decree 22 stipulates that the Ministry of Culture, Sports and Tourism (Copyright Office) is the competent authority to revoke the validity of the Certificate of Copyright Registration and the Certificate of Related Rights Registration.
Within fifteen working days from the receipt of any of the following documents, the Ministry of Culture, Sports and Tourism (Copyright Office) shall issue a decision to revoke the validity of the Certificate of Copyright Registration and the Certificate of Related Rights Registration:
- A valid Judgment, Decision of the Court, or Decision of a competent authority handling infringement acts on the revocation of the validity of the Certificate of Copyright Registration and the Certificate of Related Rights Registration.- A document from the organization or individual that has been granted the Certificate of Copyright Registration or the Certificate of Related Rights Registration, sent to the Ministry of Culture, Sports and Tourism (Copyright Office) requesting the revocation of the validity of the already granted Certificate of Copyright Registration and the Certificate of Related Rights Registration.
