Revocation of Notary Public Card in Which Cases?

This is a notable regulation in Decree 82/2020/ND-CP regarding the sanctioning of administrative violations in the fields of judicial assistance; judicial administration; marriage and family; civil judgment enforcement; bankruptcy of enterprises and cooperatives.

According to Clause 5, Article 34 of Decree 82/2020/ND-CP, the right to use the notary public card is revoked from 09 months to 12 months for any of the following acts:

- Certifying copies from originals or signatures in documents that contain illegal content, violate social ethics; propagandizing, inciting war, against the Socialist policies of Vietnam; distorting the history of the Vietnamese nation; insulting the honor, dignity, or reputation of individuals or organizations; violating citizens' rights;

- Certifying copies from originals without comparison with the originals;

- Certifying signatures in cases where at the time of certification, the requester is not aware of and cannot control his/her actions.

In addition, Decree 82 stipulates a fine from 7,000,000 VND to 10,000,000 VND for any of the following acts:

- Certifying copies from originals of documents that have been erased, corrected, added, or subtracted content improperly; originals that are damaged, old, and cannot be determined;

- Certifying copies from originals of documents issued, notarized, or certified by foreign authorities, organizations, or competent persons, which have not been legalized, except in cases where consular legalization is exempted according to the laws, international treaties that Vietnam is a member of, or on the principle of reciprocity;

- Certifying copies from originals of documents stamped confidential by competent agencies or organizations, or not stamped confidential but clearly marked not for copying;

- Certifying copies from originals of self-created personal documents without verification and sealing by competent authorities or organizations;

- Certifying signatures where the requester presents invalid ID cards, citizen identity cards, or passports, whether original or certified copy;

- Certifying signatures in documents containing contracts or transactions, except where otherwise provided by law;

- Certifying signatures related to assets or benefits of oneself or one's close relatives including spouses; biological parents, adoptive parents; biological parents, adoptive parents of the spouse; biological children, adopted children, daughters-in-law, sons-in-law; grandparents; siblings; siblings of the spouse; grandchildren from biological or adopted children of the certifier.
