Here is the noteworthy content of Decree 10/2012/ND-CP which provides detailed regulations on implementing judicial measures for education at commune, ward, and commune-level town levels for juvenile offenders, issued on February 17, 2012.
Responsibilities of supervisors of minors committing crimes subject to educational measures (Illustration)
To be specific, in Article 21 of Decree 10/2012/ND-CP, it is stipulated that during the period of direct supervision and education assignment to minors committing crimes and subjected to educational measures at commune, ward, and commune-level town, the assigned supervisor has the following responsibilities:
- Regularly meet directly with the educated individual and their family to understand their sentiments, aspirations, causes, circumstances, and motives leading to the legal violations; guide the educated individual in complying with the law, fulfilling their rights and obligations, making reports, self-evaluations, and commitments to correct mistakes;- Suggest specific management, education, and assistance measures to the commune-level People's Committee, social organizations, schools, relevant agencies, and organizations to help the educated individual with studying, job searching, production, business, residence registration, temporary residence, obtaining an Identity Card, issuing a judicial record certificate, participating in movements, and collective activities in the place of residence, addressing difficulties, and stabilizing their life;- Coordinate with commune-level police, self-defense militia, residential groups, hamlets, villages, quarters, and clans where the educated individual resides and their family to manage, educate, and assist the educated individual;- Consider and resolve the educated individual's absence from the residence, report and propose relocation of the educated individual's residence according to the regulations in Articles 10 and 11 of Decree 10/2012/ND-CP;- Regularly review and evaluate the policy and law compliance, local regulations, fulfillment of obligations, and progress of the educated individual;- Report and propose to terminate the duration of educational measures at commune, ward, and commune-level town for the educated individual who meets the conditions and standards as stipulated in Article 12 of Decree 10/2012/ND-CP;- Timely detect and notify the Commune-level People's Committee, police, or social organizations, schools, of any symptoms, attitudes, and illegal behaviors of the educated individual for appropriate preventive, management, educational measures, and strict legal handling;- Regularly or upon request report to the commune-level People's Committee, social organizations, schools, on the situation and results of educational measures at commune, ward, and commune-level town for minors committing crimes as per regulations.
Note: Persons assigned the responsibility of supervision and education are allowed to participate in training courses, receive allowance policies for non-specialized workers at the commune level, and are prioritized to be exempted from or reduced other obligations as stipulated by the law and local regulations.
