This is one of the notable contents in Circular 13/2018/TT-BCA which stipulates the conditions of facilities, equipment, and minimum means of expertise for public forensic examination organizations in the field of criminal technique. So how is this responsibility specifically stipulated?
According to Article 6 of Circular 13/2018/TT-BCA, the responsibility for proposing outfits serving the assessment work is stipulated as follows:
Director of the Institute of Criminal Science, Ministry of Public Security is responsible for advising the leadership of the General Department of Police:
- Proposing to the leadership of the Ministry of Public Security the arrangement of working space for the institute’s leadership, room and center leaders, expert examiners, assistants of the institute, and other working areas for the institute and its affiliated rooms and centers.- Proposing to the leadership of the Ministry of Public Security the provision of machinery and equipment for the institute’s leadership, leaders of rooms and centers under the institute, expert examiners, and assistants working at the institute in accordance with the standards stipulated in Circular 13/2018/TT-BCA.- Cooperating with the General Department of Logistics - Engineering to research and propose to the leadership of the Ministry of Public Security for approval of equipping specialized technical means for the criminal technical and forensic forces of the People's Police according to the regulations in Decree 151/2017/ND-CP.
Head of the Criminal Technical Department of Provincial Police is responsible for:
- Proposing the Director of Provincial Police to arrange working space conditions for the department's leadership, expert examiners, department assistants, and other working areas for the unit.- Proposing the Director of Provincial Police to equip machinery and equipment for the department's leadership, expert examiners, and assistants working at the unit in accordance with the standards stipulated in Circular 13/2018/TT-BCA.- Advising the Director of Provincial Police to report and propose the Chairman of the Provincial People's Committee to support from local funding sources to purchase and equip additional devices beyond those provided by the Ministry of Public Security to enhance the capability of the Provincial Police Criminal Technical Department to better meet the requirements of forensic assessments.
Head of the Forensic Technical Examination Department, Ministry of National Defense is responsible for proposing the competent authorities under the Ministry of National Defense:
- Arranging working space conditions for the department's leadership, expert examiners, assistants, and other working areas for the unit based on the standard regulations of Circular 13/2018/TT-BCA.- Equipping machinery and devices for the department's leadership, expert examiners, and assistants working at the unit based on the standard regulations of Circular 13/2018/TT-BCA.- Approving the provision of specialized technical means serving the forensic technical assessment for the unit based on the standard regulations of Circular 13/2018/TT-BCA.
Based on the service life of the devices, before the devices expire in 12 months, the Director of the Institute of Criminal Science, and Head of the Forensic Technical Examination Department of the Ministry of National Defense are responsible for reviewing, proposing the competent authorities for approval to upgrade or provide new replacements to ensure the equipment that has expired or is damaged is promptly, accurately upgraded or replaced, in line with the regional and global technology and standards, meeting the requirements for crime prevention and law violation.
