On February 06, 2018, the Ministry of Construction issued Circular 02/2018/TT-BXD regulating environmental protection in the construction of buildings and reporting policies on environmental protection activities in the Construction sector.
The project owner in construction execution must be responsible for environmental protection as stipulated in Circular 02, specifically:
- Develop an environmental management and protection plan based on the environmental management program in the environmental impact assessment report that has been approved by the competent authority or the environmental protection plan that has been confirmed by the competent authority.- Arrange personnel in charge of the environment in accordance with environmental protection laws to inspect and supervise contractors in implementing the environmental management and protection plan and environmental protection regulations during construction.- Allocate sufficient funds to implement the environmental management and protection plan during construction.- Organize the inspection and supervision of contractors' compliance with environmental protection regulations during construction.- Suspend construction and require the contractor to rectify to ensure compliance with environmental protection requirements when serious environmental protection violations or the risk of a serious environmental incident are detected during construction.- Coordinate with the construction contractor to address and rectify pollution, environmental incidents; promptly report and cooperate with competent authorities to resolve serious pollution, environmental incidents, and arising issues.
