On December 8, 2022, the Vietnam General Confederation of Labour issued Decision 5692/QD-TLD regulating the policies for allowances of union officials at all levels.

Decision 5692/QD-TLD

In this decision, the subjects, allowance coefficients, and responsibility allowance levels for union officials at all levels are stipulated as follows:

1. Responsibility Allowance Levels for Grassroots Union Officials in 2023

* Subjects Eligible for Responsibility Allowances

(1) Chairpersons of grassroots unions, member grassroots unions, and affiliate unions (if any);

(2) Vice-Chairpersons of grassroots unions, member grassroots unions, and affiliate unions (if any);

(3) Heads of grassroots union inspection committees, executive committee members of grassroots unions, member grassroots unions, and affiliate unions (if any);

(4) Heads and deputy heads of union groups.

* Responsibility Allowance Coefficient

The responsibility allowance coefficient for grassroots union officials is determined based on the number of union members and the union dues paid in the previous year, according to the framework number of union members, as follows:

- For the position of grassroots union chairperson:

- The remaining subjects mentioned in (2), (3), (4) above: the executive committee of the grassroots union shall base on approved expenditure sources to concretize the allowance coefficients in the grassroots union’s internal expenditure regulations, according to the framework number of union members, subjects eligible for allowances, prioritizing order linked to responsibility from high to low (chairperson, vice-chairperson...) and assessing the performance of the subjects receiving the allowances.

The allowance payment period can be made monthly, quarterly, semi-annually, or annually.

* Allowance Payment Levels

- For grassroots unions in public administrative and state non-business sectors

The monthly allowance amount = (Responsibility Allowance Coefficient) x (State statutory pay rate).

Where the statutory pay rate is currently determined as follows:

+ From January 1 – June 30, 2023: the statutory pay rate is 1,490,000 VND/month (according to Clause 2, Article 3 Decree 38/2019/ND-CP).

+ From July 1, 2023: the statutory pay rate is 1,800,000 VND/month (according to Resolution 69/2022/QH15).

Thus, from July 1, 2023, the highest monthly responsibility allowance for grassroots union officials in the public administrative and state non-business sectors is 1,800,000 VND/month.

- For grassroots unions in enterprises and unions outside the state sector

The monthly allowance amount = (Responsibility Allowance Coefficient) x (Region-based minimum wage as regulated by the State).

Where the current Region-based minimum wage according to Article 3 Decree 38/2022/ND-CP is determined as follows:

+ Region-based minimum wage I is 4,680,000 VND/month;

+ Region-based minimum wage II is 4,160,000 VND/month;

+ Region-based minimum wage III is 3,640,000 VND/month;

+ Region-based minimum wage IV is 3,250,000 VND/month.

Thus, for grassroots union officials in enterprises and unions outside the state sector, the highest monthly responsibility allowance can be up to 4,680,000 VND.

2. Responsibility Allowance Levels for Officials of Higher-Level Unions

* Subjects Eligible for Responsibility Allowances

- Members of the executive committee of higher-level unions;

- Members of the inspection committee of higher-level unions;

- Members of the women’s union committee of higher-level unions.

* Responsibility Allowance Coefficient

The responsibility allowance coefficient for officials of higher-level unions is determined based on the average number of employees participating in social insurance, which is the basis for calculating union dues in the management unit’s scope in the previous year. Specifically, as follows:

* Allowance Payment Levels

The monthly responsibility allowance for officials of higher-level unions = (Responsibility Allowance Coefficient) x (State statutory pay rate).

3. Responsibility Allowance Levels for Officials of Provincial, Central Sector, and Equivalent Unions

* Subjects Eligible for Responsibility Allowances

- Members of the executive committee of provincial labor unions, city labor unions, central sector unions, and equivalent unions;

- Members of the inspection committee of provincial labor unions, city labor unions, central sector unions, and equivalent unions;

* Responsibility Allowance Coefficient

The responsibility allowance coefficient for officials of provincial, central sector, and equivalent unions is determined based on the average number of employees participating in social insurance, which is the basis for calculating union dues in the management unit’s scope in the previous year. Specifically, as follows:

* Allowance Payment Levels

The monthly responsibility allowance for officials of provincial, central sector, and equivalent unions = (Responsibility Allowance Coefficient) x (State statutory pay rate).

4. Responsibility Allowance for Officials of the Vietnam General Confederation of Labour

* Subjects Eligible for Responsibility Allowances

- Members of the Executive Committee of the Vietnam General Confederation of Labour;

- Members of the Inspection Committee of the Vietnam General Confederation of Labour.

* Responsibility Allowance Coefficient

- Members of the Executive Committee, allowance coefficient: 0.50.

- Members of the Inspection Committee, allowance coefficient: 0.40.

* Allowance Payment Levels

The monthly responsibility allowance for the Executive Committee and Inspection Committee of the Vietnam General Confederation of Labour = (Responsibility Allowance Coefficient) x (State statutory pay rate).

Decision 5692/QD-TLD is effective from January 1, 2023, replacing Decision 3226/HD-TLD dated September 20, 2021.
