Responsibilities of Vietnam Border Guards in the implementation of border diplomacy

Recently, the Government of Vietnam has issued Decree 89/2009/ND-CP stipulating the regulations on border diplomacy in border defense.

Article 14 of Decree 89/2009/ND-CP on border diplomacy activities clearly stipulates the responsibilities of Vietnam Border Guards in implementing border diplomacy as follows:

First, advising the Ministry of National Defense on state management of national borders, policies on border diplomacy activities, and organizing the implementation of border diplomacy under the directives of the Minister of National Defense and the guidance of the Ministry of Foreign Affairs to manage and protect the sovereignty and national border security, building peaceful and friendly borders.

Second, participating in state delegations, ministries, central agencies, and people's committees as directed by the Minister of National Defense and the plans of the provincial people's committees to negotiate and resolve issues related to the implementation of Treaties, Agreements on the border, and Border Cooperation Agreements as authorized to protect national sovereignty, maintain security, order, and social safety in border areas and border gates as prescribed by law.

Third, cooperating with the neighboring country's border protection forces to conduct patrols, control, manage, and protect the border line and national boundary markers; coordinating in combating crime, preventing terrorism, illegal border crossings, smuggling, drug trafficking, human trafficking across borders, money laundering, arresting criminals, rescue and disaster recovery efforts, and external propaganda to build peaceful and friendly borders.

Fourth, conducting periodic or unscheduled exchanges of related information with the neighboring country's border protection forces to:

- Notify and exchange information on the implementation of the Border Regulations Agreement, Border Cooperation Agreements; violations of territorial sovereignty; coordination in preventing and combating violations of border management and protection regulations, maintaining security, order, and social safety in border areas and border gates related to both sides of the border;- Receiving and returning violators, evidence, and vehicles violating the Border Regulations Agreement;- Sending protest letters regarding violations of the Border Regulations Agreement and signed Agreements;- Notifying restrictions or temporary border closures as mandated by law.

Fifth, inviting or making courtesy visits as invited; organizing receptions for neighboring country's border protection forces for working visits, courtesy visits to celebrate holidays, festivals, or offering condolences during national mourning, natural disasters, fires, and other activities as per plans and directives.

Finally, organizing preliminary and final summaries of border diplomacy work.
