The Trade Union Law 2012 stipulates the rights and responsibilities of trade unions in representing and protecting the legitimate rights and interests of workers.
According to the Trade Union Law, the trade union has the rights and responsibilities to:
- Guide and advise employees on their rights and obligations when entering into and performing labor contracts or working contracts with employers.- Represent the collective workforce in negotiating, signing, and monitoring the implementation of collective labor agreements.- Participate with employers in the development and supervision of the implementation of salary scales, wage tables, labor norms, wage payment regulations, bonus regulations, and labor rules.- Engage in dialogue with employers to resolve issues related to the rights and obligations of employees.- Organize legal consultation activities for employees.- Participate with authorities, organizations, or individuals empowered to resolve labor disputes.- Petition competent organizations and state agencies to review and resolve matters where the legitimate rights and interests of the workforce or an individual employee are violated.- Represent the collective workforce in initiating lawsuits at the Court when the legitimate rights and interests of the collective workforce are violated; represent the individual employee in initiating lawsuits at the Court when their legitimate rights and interests are violated and upon their authorization.- Represent the collective workforce in participating in legal proceedings in labor, administrative, and bankruptcy cases to protect the legitimate rights and interests of the collective workforce and employees.- Organize and lead strikes in accordance with the law.
In addition to the rights and responsibilities towards employees, the trade union also has other rights and responsibilities, including:
- Participate in state management and socio-economic management;- Submit draft laws, ordinances, and proposals for policy and law-making;- Attend sessions, meetings, and conferences;- Participate in inspecting, examining, and supervising the activities of agencies, organizations, and enterprises;- Propagate, mobilize, and educate employees;- Develop trade union members and grassroots trade union organizations;- The rights and responsibilities of the directly superior trade union towards employees in agencies, organizations, or enterprises where a grassroots trade union has not yet been established.
