Responsibilities of the Request Information Recipient

Circular 64/2018/TT-BQP stipulates the provision of information within the Ministry of National Defense, issued on May 15, 2018. One of the basic contents in this document is the regulation on the responsibility of the person receiving the information request.

To be specific, according to the provisions in Article 9 of Circular 64/2018/TT-BQP, the person receiving the request for information provision has the following responsibilities:

- Receive the request for information provision;- Explain, guide, notify citizens to exercise their right to access information as prescribed by law; guide, support the requester in clearly identifying the records, documents, names of documents containing the information sought to accurately and fully fill in the Request Form for information provision;- Guide, assist the requester in filling in the Form, signing the Request Form for information provision according to the form used in providing information upon request;

Guide the requester to the agency or unit responsible for providing information when the information is not within the responsibility of the agency or unit they belong to.

- Send the Request Form to the focal agency or unit for information provision.

In addition, this Circular also stipulates that the person tasked with providing information must have the following responsibilities:

- Receive the request for information provision, enter it into the Information Provision Tracking Book, and report to their superior as prescribed;- Provide information to citizens in the correct form, order, procedures, and time frame as specified in Chapter III of the Law on Access to Information, Decree 13/2018/ND-CP, and related documents; be responsible for the authenticity of the information provided;- Upon receiving a valid request for information provision, notify the requester of the timeline, location, form of information provision; actual costs for printing, photocopying, sending information via postal services, fax (if any), and methods, payment deadlines according to the form used in providing information upon request in the Appendix issued with Decree 13/2018/ND-CP;- Research and analyze the regulations on information provision to propose and recommend solutions to issues arising during the processing of information requests from citizens; compile reports on the information provision situation of their agency or unit.
