1. Subjects of Application of Decree 47/2024/ND-CP

Based on Article 2 of Decree 47/2024/ND-CP, the subjects of application are stipulated as follows:

[Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghi-dinh-47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html) applies to government agencies, organizations, and individuals involved in the development, updating, maintenance, and exploitation, usage of national databases.

Additionally, based on Article 5 of [Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghi-dinh-47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html), the determination of master data of national databases is stipulated as follows:

- Master data contains the most essential information to describe, identify, and distinguish a specific object managed by a state agency; the master data must have an object identifier code; master data is used as a basis to reference and synchronize among various databases or datasets. When master data changes, data in the reference databases must be synchronized accordingly.

- The master data of a national database holds official value, equivalent to the paper document containing the same information provided by a competent authority unless otherwise specified by law.

2. Responsibility of the Supervisor of National Databases under Decree 47/2024/ND-CP

Based on Article 17 of [Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghi-dinh-47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html), the responsibilities of the supervisor of national databases are stipulated as follows:

- Take charge of developing, maintaining national databases, updating data within their management scope into the national databases, and ensuring continuous, stable, and smooth operation to meet the exploitation and usage demands of agencies, organizations, individuals as per legal regulations.

- Execute the responsibility of overseeing the national database information system as prescribed in Article 25 of the Law on Network Information Security 2015, November 19, 2015, Article 20 of [Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghi-dinh-47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html), July 1, 2016, by the Government of Vietnam, on ensuring the security of information systems by level and carry out the responsibility of overseeing information systems critical to national security as specified in the Cybersecurity Law 2018, June 12, 2018, when national database information systems are identified as systems critical to national security.

- Assign units to manage, maintain data; ensure organizational structure, personnel management; attract, recruit, train, foster, and hire personnel to serve the development, updating, maintenance, exploitation, and usage of national databases within their management scope.

- Ensure infrastructure conditions for data connection and sharing as stipulated in Article 27 of [Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghi-dinh-47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html); execute the connection and sharing of national database data with other databases and information systems via the National Data Integration and Sharing Platform and the Ministry/Province Data Integration and Sharing Platform; provide data from the national database to the National Data Portal to serve agencies, organizations, and individuals in exploiting information as per the regulations in [Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghidinh- 47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html).

- Take charge, cooperate with the Ministry of Information and Communications to ensure network information security and protect the information system as per legal regulations on network information security.

- Take charge, cooperate with the supervisor of the National Data Center to develop plans, roadmaps, and propose budgets to transfer the national database information system to the National Data Center, ensuring safety and avoiding waste.

- Ministers and Heads of institutions overseeing national databases:

+ Take charge, cooperate with relevant agencies to build explanatory proposals for national databases as stipulated in Article 6 of [Decree 47/2024/ND-CP](https://lawnet.vn/vb/Nghidinh- 47-2024- ND-CP-danh-muc-co-so-du-lieu-quoc-gia-94C49.html); cooperate with other national database supervisors, ministries, central authorities, and local authorities to ensure the proposed national databases meet the requirements, are uniformly organized, and are managed according to the management responsibilities of state agencies;

+ Guide the process of collecting, updating, and adjusting information in the national database within their management scope;

+ Take charge, cooperate with the Minister of Information and Communications and relevant agencies to develop and issue regulations on technical specifications for data structure, exchange, connection, and sharing of national databases with the databases of ministries, central authorities, and local authorities; regulations on exploiting and using data from the national databases within their management scope;

+ Take charge of developing, issuing, or submitting competent authorities to issue legal normative documents specifying agencies authorized to extract master data from national databases. Master data in the national databases holds official value, equivalent to paper documents provided by competent authorities unless otherwise specified by law.
