Responsibilities of the Civil Aviation Authority of Vietnam in the management and assurance of flight operations

Pursuant to Clause 1, Article 7 of Circular 19/2017/TT-BGTVT, as amended and supplemented by Clause 4, Article 1 of Circular 32/2021/TT-BGTVT, the responsibilities of the Civil Aviation Authority of Vietnam in the field of air traffic management and operations assurance are as follows:

(1) To exercise authority over airspace regulations within airport zones, flight procedures of civil aviation, plans, instructional materials, processes, and methods related to flight operations assurance as prescribed in Decree 125/2015/ND-CP, which details regulations on air traffic management, and other relevant legal documents;

(2) To develop strategies, plans, and policies for the development of air traffic management and operations assurance systems for submission to the Ministry of Transport for approval;

(3) To research, propose the application, and organize the implementation of ICAO, WMO standards, regulations, guidelines, and technologies related to air traffic management and operations assurance in compliance with laws and international treaties to which Vietnam is a member;

(4) To formulate plans and report to the Ministry of Transport for collaboration with the Ministry of National Defense for submission to the Prime Minister of the Government of Vietnam to decide on the establishment or cancellation of air routes and approve the boundaries of the FIR over international waters managed by Vietnam and organize implementation according to laws;

(5) To organize the determination of responsibility areas for providing air traffic operations assurance services; manage the provision of air traffic operations assurance services;

(6) To direct, inspect, and supervise flight inspection, calibration of systems, navigation equipment, air traffic supervision, and flight evaluation procedures using civil aviation equipment; manage and use aviation frequencies as required;

(7) To publish a list of alternate airports serving civil aviation flights; the limited surfaces of aviation obstacles; AIP, AIP amendments, AIP supplements, AIC, aviation charts and maps; organize the compilation and issuance of various types of aviation charts; terrain and aviation obstacle data for civil aviation operations;

(8) To organize the development and implementation of civil aviation search and rescue plans; organize industry-level search and rescue drills; coordinate civil aviation search and rescue with related countries in the region; organize the implementation of civil aviation flight operations responses;

(9) To organize the training management of air traffic operations assurance personnel;

(10) To organize examinations; issue, extend, revoke, and suspend licenses for air traffic operations assurance personnel; licenses for operating systems, equipment ensuring flight operations; and licenses for operating ANS facilities; assign codes, technical addresses for CNS systems, and aircraft electronic devices registered to Vietnam;

(11) To ensure the safety of air traffic operations and the provision of air traffic operations assurance services; organize the implementation of runway safety programs;

(12) To organize the investigation of accidents and incidents related to air traffic operations and assurance; inspect, supervise compliance with air traffic management and operations assurance regulations, and handle violations according to laws;

(13) To direct, inspect, and supervise the signing of coordination agreements between Vietnam's ATS facilities and foreign ATS facilities, international cooperation agreements in air traffic operations assurance; international cooperation in air traffic management and operations assurance, and implement other tasks as prescribed by laws.
