The Ministry of National Defense issued Circular 135/2017/TT-BQP on May 26, 2017, specifying the responsibilities of the agency in charge of preserving evidence.
Accordingly, the responsibilities of the agency or unit sending the exhibits are regulated by Circular 135 as follows:
- Agencies and competent individuals conducting proceedings in the Army that are handling the case, or related agencies and units sending exhibits under the management of the Ministry of National Defense, are responsible for preparing an exhibit management dossier and transporting the exhibits to agencies or units tasked with managing and preserving the exhibits, along with related documents (if any).- When transferring the case file, the transferring agency must notify in writing the agency or unit assigned to manage and preserve the exhibits.- When transporting exhibits that require special means of transport, the agency sending the exhibits shall take the lead, in cooperation with related agencies and units, and the agency or unit assigned to manage and preserve the exhibits, to organize the transportation, ensuring the safety of both the exhibits and the environment.
In addition, Circular 135 also stipulates that the agency or unit assigned to manage and preserve the exhibits is responsible for immediately receiving the exhibits and documents, and managing and preserving them safely when the agency or competent person conducting proceedings in the Army, or related agencies and units, contact and send the exhibits.
