This issue is mentioned in Circular 23/2018/TT-BQP on regulations for the policies of management, storage, exploitation, and use of detention and custody management records in the Army, issued on March 8, 2018. So, specifically, what responsibilities do organizations and individuals have in the exploitation of TGTG management records?
According to the provisions of Article 8 of Circular 23/2018/TT-BQP, in the exploitation of temporary detention and custody management dossiers, organizations have specific responsibilities as follows:
* Organizations and individuals requesting to exploit documents in temporary detention and custody management dossiers must present:
- Introduction letter or proposal letter from the agency, organization, or request form with the confirmation of the People's Committee of the commune where they reside (if an individual). The content of the introduction letter or proposal form includes:- Full name, rank, position (if any), workplace of the person being introduced, residence of the individual making the request;- Purpose of requesting to exploit documents in the temporary detention and custody dossiers; if there is a need to copy or photograph documents, the specific documents to be copied or photographed must be stated.- Identification card, passport, or citizen identity card, proof of armed forces, card or certificate from the Investigation, Prosecutor, Court sector when performing tasks;- Written consent from the agency handling the case to exploit the temporary detention and custody management dossiers when the case is in the stages of investigation, prosecution, trial.
* Responsibilities of organizations and individuals in exploiting documents, temporary detention and custody management dossiers:
- Comply with the procedures and instructions of the officers of the agency or unit managing the dossiers to read, copy, and photograph documents according to the regulations of this Circular;- Maintain the confidentiality of dossiers and documents;- Comply with the regulations of the agency or unit managing the temporary detention and custody management dossiers during the exploitation process;- Individuals exploiting the temporary detention and custody management dossiers are only permitted to read, take notes, and copy documents after registering and being approved by the Head of the temporary detention and custody management dossier management agency. The reading, copying, and photographing of dossier documents must be recorded and signed in the monitoring book.
* Responsibilities of officers supervising dossier exploitation:
- Must directly supervise the process of exploiting dossiers and documents by individuals exploiting the temporary detention and custody management dossiers;- Hand over and receive back the dossiers and documents fully and intact;- Directly copy and hand over the copied documents to the requesting organization or individual;- Prevent individuals exploiting documents from performing acts prohibited under Article 4 of Circular 23/2018/TT-BQP, and if violations are detected, immediately stop the exploitation of the dossier, make a minute, and report to the Head of the temporary detention and custody management dossier management agency.
