On October 05, 2018, the Ministry of Agriculture and Rural Development issued Circular 12/2018/TT-BNNPTNT specifying the responsibilities of organizations and individuals involved in the importation and production of plant protection drugs.
Responsibilities of organizations and individuals importing and producing plant protection drugs are specified in Circular 12 as follows:
- Announce conformity for plant protection drug products as prescribed.- Continuously maintain and be responsible for the conformity of plant protection drugs that have been declared to conform to standards; maintain quality control, testing, and periodic monitoring.- In cases of self-assessment of conformity by organizations or individuals: Submit semi-annual and annual or ad-hoc reports on declaration of conformity activities to the Plant Protection Department. Report submission deadlines are June 15 and December 15 each year.- Use the conformity mark for products that have been declared to conform to standards before circulating in the market.- Note, upon detecting non-conformity of plant protection drugs that have been declared to conform to standards during circulation or usage, organizations or individuals must:- Timely notify in writing about the non-conformity to the Department of Agriculture and Rural Development where the business is registered and the Plant Protection Department; temporarily suspend the shipment and recall non-conforming products and goods circulating in the market.- Implement corrective measures for the non-conformity; notify in writing to the Department of Agriculture and Rural Development where the business is registered and the Plant Protection Department about the results of the corrective measures before continuing to circulate products and goods in the market.
