Responsibilities of Ministries, ministerial-level agencies in border diplomacy in Vietnam

This is an important provision in Decree 89/2009/ND-CP regulating border diplomacy.

The Government of Vietnam stipulates the state management responsibilities for border diplomacy of Ministries and ministerial-level agencies in Decree 89/2009/ND-CP regarding border diplomacy as follows:

+ For Ministry of National Defense:

- Preside over, cooperate with Ministry of Foreign Affairs and relevant Ministries and sectors to direct and guide the People's Committees of provinces and centrally-run cities in implementing state management over national borders. Coordinate with the Ministry of Foreign Affairs to propose policies on border diplomacy and participate in delegations negotiating border and territorial issues; develop legal documents on management and protection of national borders, and organize the management and protection of national borders within its authority;

- Be responsible to the Government of Vietnam for the implementation of state management over border diplomacy and cooperate with the Ministry of Foreign Affairs to direct, guide relevant agencies on professional activities regarding border diplomacy;

- Sign agreements on border defense cooperation with the Ministry of Defense (relevant Ministries and sectors) of neighboring countries on issues related to management, protection of national borders, maintaining security, and order in border areas, and border gates of the two countries as prescribed by law;

- Engage in international cooperation on border defense and conduct border diplomacy to coordinate the management and protection of national borders, and build peaceful and friendly borders with neighboring countries;

- Direct and guide the Border Guard to carry out border diplomacy and resolve bilateral border issues within its authority. Periodically organize preliminary and final reviews of border diplomacy.

+ For Ministry of Foreign Affairs:

- Provide information related to border external affairs (state policies on external relations, resolution of border and territorial issues with neighboring countries; the status of relations between us and friendly countries, the status of border and territorial issues...) to facilitate the planning of border diplomacy;

- Coordinate with the Ministry of National Defense in directing and guiding relevant Ministries, sectors, provincial People's Committees, and the Border Guard in carrying out border diplomacy;

- Train and educate cadres of relevant Ministries, sectors, provincial People's Committees, and the Border Guard on legal knowledge, international border treaties, and professional border diplomacy to implement external activities and handle bilateral border and foreign-related issues at border areas and border gates.

Within the scope of their duties and powers, Ministries, ministerial-level agencies, and agencies under the Government of Vietnam are responsible for organizing the implementation of border diplomacy according to the provisions of law, the guidance of the Ministry of National Defense, and the Ministry of Foreign Affairs.
