Responsibilities of Employers towards Employees Working in Confined Spaces

Circular 29/2018/TT-BLDTBXH was issued by the Ministry of Labor, War Invalids and Social Affairs on December 25, 2018, to specifically stipulate the responsibilities of employers towards employees working in confined spaces.

Accordingly, Circular 29 stipulates that employers are responsible for:

- Appointing a licensing person, authorizing a licensing person, and suspending work when it is not performed in conformity with permits related to working in confined spaces or not ensuring labor safety and hygiene.- Assigning someone to measure and inspect gases in confined spaces at risk of oxygen deficiency or containing toxic gases, explosive gases.- Setting competency requirements and minimum standards for positions such as: individuals entering confined spaces, confined space guards, individuals measuring and inspecting gases in confined spaces, supervisors, commanders, and licensing personnel.- Being responsible for promulgating safety and labor hygiene procedures when performing tasks related to confined spaces and procedures to control other tasks if any, to ensure the safety of workers entering confined spaces.- Ensuring that supervisors, commanders, licensing personnel, individuals entering confined spaces, and confined space guards are trained and instructed in labor safety and hygiene.
