Responsibilities and rights of organizations and individuals involved in adoption of reservoir operation procedures in Vietnam

Recently, the Government of Vietnam has issued the Decree No. 114/2018/NĐ-CP on dam and reservoir safety management.

According to the Decree No. 114/2018/NĐ-CP of Vietnam’s Government, responsibilities and rights of organizations and individuals involved in adoption of reservoir operation procedures are specified as follows:

- The dam and reservoir manager shall provide guidelines for, check and supervise the adoption of procedures for operation of reservoirs and inter-reservoirs approved by competent regulatory agencies;

- Chairpersons of provincial People’s Committees shall provide guidelines for inspection and supervision of the adoption of procedures for reservoirs and inter-reservoirs under provincial management and provide guidelines for safety assurance and emergency response for dams and reservoirs under management, and notify the Prime Minister of emergencies beyond the provincial capacity of response;

- The head of the Steering Committee for natural disaster prevention and control, search and rescue of provinces shall put a close watch on development of rains and floods, decide flood regulating plans, issue reservoirs operation order and decision on emergency flood discharge for dams and reservoirs in the area under management as authorized and notify emergencies beyond the provincial capacity of response to the head of central Steering Committee for natural disaster prevention and control;

- The Minister of Agriculture and Rural Development and Minister of Industry and Trade shall provide guidelines for and carry out inspection of the adoption of procedures for reservoirs and inter-reservoirs approved by competent regulatory agencies proposed by operators of dams and reservoirs under ministerial management, provide guidelines for taking emergency response measures and work out methods for emergency response for dams and reservoirs under ministerial management, and notify emergencies beyond ministerial capacity for response to the Prime Minister and the head of the central Steering Committee for natural disaster prevention and control;

- The head of the central Steering Committee for natural disaster prevention and control shall provide guidelines for prevention and control of floods hitting dam lowlands as authorized and assigned and give assistance in seeking emergency response methods in case such emergency is beyond the local or ministerial capacity.
