Resolution of Second-Time Complaints in the Military: Procedures and Processes

Recently, the Minister of National Defense signed and promulgated Circular 218/2013/TT-BQP guiding complaints and resolution of complaints within the Army.

In Article 17 of Circular 218/2013/TT-BQP, the procedures for resolving a second complaint are stipulated as follows: The steps are similar to resolving the first complaint, but the following additional procedures must be conducted:

- The authority responsible for resolving the second complaint must engage in a dialogue with the complainant, the complained party, the individual with rights and obligations related to the case, and relevant organizations and individuals to clarify the complaint's content, the complainant's demand, and the resolution direction.- For complicated cases, if deemed necessary, the authority resolving the second complaint shall establish a consulting council to seek advice on the complaint resolution.- Within 03 working days from the date of signing the complaint resolution decision, the authority responsible for resolving the second complaint must send the decision to the complainant, the complained party, the direct superior of the authority resolving the complaint, the individuals with related rights and obligations, and the state inspection agency at the same level.
