Resolution for Cases of individuals who become seriously ill, contract terminal illnesses, or die after rehabilitation in Vietnam

This is a notable content in Decree 94/2009/ND-CP guiding the amended Law on Drug Prevention and Control regarding post-rehabilitation drug addiction management in Vietnam.

Article 32 of Decree 94/2009/ND-CP stipulates the resolution for cases where post-rehabilitation individuals fall severely ill, suffer terminal illness, or pass away. To be specific: 

1. For post-rehabilitation individuals who become seriously ill or suffer from terminal illness beyond the treatment capacity of the Center, the resolution is as follows:

- They shall be transferred to State medical facilities for treatment or sent back home for care.

- The medical examination and treatment costs shall initially be covered by the Center, which will then require reimbursement from the individual or their family.

- In cases where the individuals hold valid Health Insurance cards, the medical examination and treatment costs shall be covered by the Social Insurance Fund as per current regulations.

- For those who are categorized as poor or near-poor, or those from policy families without Health Insurance cards, and upon submission of a request, the Center shall consider providing partial or full financial aid for medical examination and treatment costs.

- Minors shall receive 100% financial aid for medical examination and treatment costs. The Center is responsible for managing the post-rehabilitation individuals during their care and treatment at medical facilities.

2. In the event that a post-rehabilitation individual dies while serving their decision period:

- The Center Director must immediately report to the Investigation Agency, the Procuracy, and the Medical Department where the Center is located to determine the cause of death, and at the same time notify the deceased individual's relatives to conduct funeral arrangements.

- In cases where the deceased has no relatives or the relatives do not arrive in time, the Center is responsible for organizing the funeral within 24 hours. The Center shall cover the costs of forensic examination and funeral expenses as per current legal provisions.
