Decree 122/2018/ND-CP was issued by the Government of Vietnam on September 17, 2018. This Decree specifically stipulates the standards for considering the title of Cultural Residential Area.
To be specific, according to the provisions of Article 12 of Decree 122/2018/ND-CP, the standards for the title of Cultural Residential Area include:
- Stable and progressively developing economic life, including the following criteria:
- Working-age individuals have jobs and stable incomes;- Per capita income higher than the provincial or centrally-governed city average;- The proportion of poor and near-poor households is lower than the general average;- The proportion of households with permanent housing is higher than the general average, with no dilapidated houses;- The main traffic system is paved, ensuring convenient travel;- There are activities for propaganda, dissemination, and training on the application of technology and technical science; development of traditional handicrafts; cooperation and linking for economic development.
- Healthy and rich cultural and spiritual life, including the following criteria:
- Having cultural houses and sports fields suitable for the residential area's conditions;- Children of school age attend school, meeting at least the standard for secondary education universalization;- Organizing healthy cultural, artistic, sports, recreation, and entertainment activities; having community reading points; performing well in reconciliation work;- Preserving and promoting traditional local folk cultural and sports activities;- Preserving and protecting historical-cultural sites and scenic spots.
- Clean and beautiful environmental landscape, including the following criteria:
- Production and business activities comply with the legal regulations on environmental protection;- Having a water supply and drainage system;- Housing, public works, and cemeteries suitable with local planning;- Public recreational areas are renovated, protected, and kept clean;- There are locations allocated for advertising and announcements;- Having waste collection points;- Conducting propaganda activities to raise people's awareness about environmental protection;- Organizing and participating in disease prevention activities.
- Good compliance with the guidelines and policies of the Communist Party and the laws of the State, including the following criteria:
- Implementing legal regulations and population policies;- Implementing grassroots democracy regulations, creating conditions for people to monitor the activities of state agencies; effective operation of self-management organizations in the community;- The percentage of malnourished children decreases annually, and children are fully vaccinated;- Conducting legal propaganda and dissemination activities;- Meeting security and order safety standards;- The Communist Party branch and mass organizations annually complete their missions well.
- Community solidarity, support, and mutual assistance, including the following criteria:
- Implementing the State's policies on humanitarian and charitable activities and promoting movements such as "Gratitude," "Remembering the source when drinking water," "Campaign for the poor," and other campaigns;- Taking care of the elderly, children, people with meritorious services, people with disabilities, wanderers, homeless individuals, and people in difficult circumstances.
In addition, this Decree also stipulates cases where the title of Cultural Residential Area is not awarded, specifically when the residential area violates one of the following cases:
- Having unlawful mass petitions and appeals;- Having drug and prostitution hotspots;- Having activities that exploit religion to violate the law.
