On April 05, 2017, the Ministry of Justice issued Circular 03/2017/TT-BTP specifying the requirements for the intermediate bailiff position.
According to Circular 03, the regulations for officials at the intermediate executioner rank must meet the following requirements:
- Master the policies of the Communist Party, the laws of the State, directives, and resolutions of the higher authorities to apply them to the work of civil and administrative enforcement;- Have a deep understanding of the legal provisions on civil and administrative enforcement; proficiently apply the principles, policies, and procedures on civil enforcement operations;- Understand the situation and development trends of civil enforcement work in the country and the world; organize research to serve management and handle management information;- Have the ability to cooperate well with relevant agencies in the enforcement of judgments;- Have the ability to educate and persuade the involved parties to enforce the court's judgments and decisions; the decisions of the Council for Handling Competition Cases and the awards and decisions of the Commercial Arbitration;- Have the capability to analyze, aggregate, and proficiently document and relate to the responsibilities and tasks assigned and present the issues assigned;- For officials taking the examination to upgrade to the intermediate executioner rank, they must have led or participated in the drafting of at least one legal normative document or led or participated in research, construction of at least one project, proposal, or scientific research program at the Ministry, sector, provincial, or district level issued or approved by competent authorities and evaluated as meeting the requirements or have led the construction and effective implementation of at least one project, proposal, or initiative within the Civil Execution Department or the Civil Execution Sub-department;- Officials taking the examination for upgrading to the intermediate executioner rank must have held the junior executioner rank for at least 5 years (60 months).
