On November 27, 2020, the Government of Vietnam issued the Decree No. 138/2020/NĐ-CP of the Government of Vietnam on recruitment, employment and management of officials.
According to Article 9 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, successful candidates in the officials recruitment exam must meet the following conditions:
- Having a score of 50 or more in round 2. In case the exam combines interview and writing, the candidate must participate in both interview and writing test;
- Having the result of the test in round 2 plus the priority score specified in Article 5 of this Decree (if any) is higher, in order of points from highest to lowest in the recruitment criteria of each job position.
In case there are 02 or more people with the same total score as prescribed in Point b, Clause 1, Article 9 in the final criterion of the job position to be recruited, the person with the higher score in round 2 of examination is elected; if still undetermined, the head of the agency competent to recruit officials shall decide on the successful candidate.
Those who do not pass the officials recruitment exam are not allowed to reserve their exam results for the next recruitment exams.
Note: According to Article 6 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, the agency competent to recruit officials is the agency specified in Clause 1 Article 39 of the Law on Officials amended by Clause 6 Article 1 of the Law on Amendments to the Law on Officials and Public Employees of Vietnam. Agencies, organizations and units are assigned payrolls, operating funds, have their own seals and accounts, and are authorized to recruit officials.
