Requirements for publishing houses and their partners in joint publication activities in Vietnam

Recently, the Government of Vietnam issued Decree No. 195/2013/NĐ-CP detailing a number of articles of, and measures for implementing, the Publication Law.

According to Article 11 of Decree No. 195/2013/NĐ-CP of Vietnam’s Government, in addition to complying with Article 23 of the Publication Law, publishing houses and their partners must meet the following requirements:

The association is only made only with the following conditions:

- There is a written consent of the author, the copyright owner under the provisions of the law on intellectual property rights for works and materials of associated publishing;

- There is a publishing association contract between publishers and associated partners. The association contract must have the basic contents as prescribed by the Minister of Information and Communications;

- In case of preliminary editing association of manuscript, in addition to the conditions specified at Points a and b of this Clause, the associated partner must have editors;

- For works and materials with the content on political theory, history, religion, national sovereignty, memoir, the publisher is not allowed for preliminary associated editing of manuscript.

Publishing houses and their partners must meet the following requirements:

- For publishing houses: To sign printing contracts directly with printing establishments having publication printing permits and sign publication distribution decisions.

- For partners:

+ To have certified copies of identity cards or passports which remain valid in accordance with law, for the individuals prescribed at Point a, Clause 1, Article 23 of the Publication Law, or certified copies of the papers proving the legal person status, for the organizations prescribed at Point c, Clause 1, Article 23 of the Publication Law;

+ To have papers proving that it has a staff of at least 3 (three) editors possessing editing practice certificates, in case of joint publication in the form of preliminary editing of manuscripts;

+ To comply with publication decisions of the general director (director) of the publishing house; to correct, suspend the distribution, withdraw or destroy publications under decisions of the general director (director) of the publishing house.
