Requirements for Maritime Facility Maintenance according to Circular 52/2017/TT-BGTVT

Below is the basic content mentioned in Circular 52/2017/TT-BGTVT regarding the regulations on the maintenance of maritime works, issued on December 29, 2017. To be specific:

1. Maritime works after completion of new construction, upgrading, renovation, and repair are accepted, handed over, managed, and maintained. The maintenance period is calculated from the date the owner, manager, operator, or user signs the acceptance minutes for putting the maritime works into operation and use.

2. The maintenance of maritime works is carried out in accordance with Circular 52/2017/TT-BGTVT, maintenance procedures, standards, technical regulations, economic-technical norms for the management and maintenance of maritime works, and relevant legal regulations.

3. Maintenance procedures for maritime works:

- The preparation, appraisal, approval, and adjustment of the maintenance procedures for the works are carried out in accordance with Article 38 of Decree 46/2015/ND-CP;- The investor is responsible for handing over maintenance-related documents to the owner or authorized person before handing over the works for operation and use;- For maritime works that have been put into operation and use but do not yet have approved maintenance procedures: the owner or the manager, operator, or user is responsible for organizing and approving the maintenance procedures for the maritime works, to be completed before December 31, 2018, and reporting to the Vietnam Maritime Administration.

If necessary, quality inspection of maritime works can be organized to serve as a basis for establishing the maintenance procedures for maritime works. The maintenance procedures must clearly determine the remaining service life of the works;

- For temporary maritime works (works constructed to serve the construction of the main works): it is not mandatory to establish maintenance procedures, but the owner or authorized person must still perform maintenance according to the regulations of Circular 52/2017/TT-BGTVT and Decree 46/2015/ND-CP.

4. The Vietnam Maritime Administration is responsible for reviewing, guiding, and requesting the owner or authorized person to establish maintenance procedures for maritime works that are in use but do not yet have maintenance procedures.
