Regarding this issue, LawNet would like to answer as follows:

On December 31, 2023, the Government issued Decree 98/2023/ND-CP detailing the implementation of a number of articles of the Law on Emulation and Commendation 2022.

1. Requirements for awarding and receiving emulation titles and commendation forms in Vietnam

According to Article 25 of Decree 98/2023/ND-CP, the awarding and receiving of emulation titles and commendation forms must meet the following requirements:

- The organization of the ceremony to award and receive emulation titles and commendation forms must carry the meaning of honoring the collective and individuals, educating patriotic traditions and revolutionary ideals; associated with patriotic emulation movements, carrying out socio-economic development tasks, ensuring national defense and security of the locality and country, and ensuring safety, solemnity, economy, efficiency, unobtrusiveness, and formality.

- Implement a civilized lifestyle and preserve cultural values and national identity in the ceremony of awarding and receiving emulation titles and commendation forms.

- Do not organize separate ceremonies for awarding and receiving emulation titles and commendation forms. Only held in conjunction with celebrations of major national holidays, founding days, traditional days of ministries, departments, branches, localities, units, and summary conferences according to the specific program and comply with the provisions of this Decree (except for the case of awarding rewards for extraordinary outstanding achievements, resistance achievements and the title "Heroic Vietnamese Mother").

- Representatives of the collective and household leaders who are rewarded directly receive the emulation title and reward form of the collective and household. Individuals who are rewarded directly receive the emulation title and form of reward. In case of a posthumous award, the family representative of the person receiving the award will receive it on his/her behalf.

- Awarding emulation titles and commendation forms from high to low ranks. In the case of the same form of reward, give it to the collective or household first, then to the individual; give first, posthumously later. In the event that the emulation title and form of reward are decided by the same level, the emulation title will be awarded first and the form of reward later; award to groups first, households later, and individuals later; give first, posthumously later.

- While announcing, awarding, and receiving emulation titles and commendation forms, unauthorized persons are not allowed to give flowers, film, or take photos on the stage. There are no parades or processions for emulation titles or other forms of reward given.

2. Ceremony for announcing, awarding and receiving emulation titles and commendation forms in Vietnam

The ceremony of announcing, awarding, and receiving emulation titles and commendation forms is as follows:

- The person running the ceremony is a representative of the leadership of the ministry, department, branch, the Provincial People's Committee, or the unit organizing the ceremony. The unit presiding over the ceremony to announce, award, and receive emulation titles and commendation forms must develop a script for the ceremony to announce, award, and receive emulation titles and commendation forms.

- Announcing the decision to award emulation titles and commendation forms:

+ Representative of the leadership of the agency in charge of emulation and commendation or of the unit organizing the ceremony to announce the full text of the decision to reward the emulation title and form of reward;

+ Announcing the President's Commendation Decision: Before announcing, the announcer invites the traditional flag team (if any), representatives of party committees, government leaders, the Vietnam Fatherland Front, Trade Unions, the Ho Chi Minh Communist Youth Union (or representatives of generations of leaders of the commended collective), or commended individuals to the stage to hear the announcement of the commendation decision;

+ Announcing the Decision to reward emulation titles and commendation forms by the Government and the Prime Minister: After the announcement, the announcer invites the leader representative of the collective or individual named in the commendation decision to the stage to receive the emulation title or form of commendation.

- Awarding emulation titles and commendation forms:

+ The person giving the emulation title and form of reward is the person who has the authority to decide whether to reward the emulation title and form of reward or the person authorized by the person with authority to decide on rewards to award emulation titles, forms of reward, or representatives of superior leaders to attend the ceremony; The giver stands in the center of the ceremony platform;

+ Awarded in order: Attach the Medal (or Medal, Badge with title) first; then award the Diploma and the Hero Flag (for the group receiving the Hero title);

+ For collectives with Traditional Flags: The awarder attaches the Order (or Badge with title) to the high right corner of the Traditional Flag. The placement of Orders (or Badges with titles) on the Traditional Flag is done in order from high to low;

For groups without a traditional flag: The person giving the degree has already attached the Order(or Badge with title);

+ Awarded to individuals: The giver attaches the Order (or Medal, Badge with title) to the left side of the recipient's chest, then awards the Diploma;

+ Posthumous award: The person giving the degree has already attached the Order (or Medal, Badge with title) to the family representative of the individual being awarded posthumously;

+ The awarding of emulation titles and commendation forms in some special cases, such as elderly individuals with poor health or people with disabilities, or deciding to reward many subjects, the agency presiding over the awarding ceremony shall request the opinion of the person with the authority to award or authorized to award or a representative of a superior leader attending the decision ceremony.

- Receiving emulation titles and commendation forms:

+ Receiving forms of commendation under the authority of the President: Recipients of commendations stand strictly in a horizontal row at the center of the stage to listen to the announcement of the commendation decision;

+ Receiving emulation titles and forms of commendation under the authority of the Government and Prime Minister: recipients of commendations are invited to the center of the stage to receive;

+ When receiving the Diploma (or Flag), the recipient raises the Diploma or Flag to chest height, maintaining the same position until leaving the stage;

+ In case of necessity, the representative of the collective (or individual or household) receiving the reward will express their opinions after receiving the reward.

- The person serving the ceremony gives:

+ Do not turn your back to the attendees; stand behind, to the right (dominant hand) of the giver when giving the Order (or Medal, Badge with title, Degree, Flag) to the giver;

+ Place the Order (or Medal, Badge with title, Diploma) in a tray covered with red cloth; The diploma must be enclosed in a frame; Hold the tray, give the Medal, Diploma, and Flag with both hands to the giver.
