Regarding this issue, LawNet would like to answer as follows:
On December 5, 2023, the Prime Minister issued Official Telegram 1300/CD-TTg on ensuring traffic order and safety during the New Year, Lunar New Year of Dragon and Spring Festival 2024.
On the occasion of the New Year, Lunar New Year Giap Thin, and Spring Festival 2024, it is forecasted that the flow of people and vehicles will increase sharply, creating great pressure on the work of ensuring traffic order and safety, with the potential risk of traffic accidents and jams.
To prevent traffic accidents and maintain traffic order and safety to serve the People celebrating the New Year, the Lunar New Year of the Dragon, and the 2024 Spring Festival, the Prime Minister requests:
- The Ministry of Public Security directs police units and localities to strengthen patrols, control, and strictly handle violations of traffic order and safety on roads, railways, and waterways;
- Focusing on handling violations that are the direct cause of traffic accidents and jams, such as violating regulations on alcohol and drug levels, speeding over regulations, driving on the wrong side of the road or lane, going in the opposite direction, stopping, parking illegally, turning around, avoiding, overtaking illegally, not wearing a helmet when riding a motorcycle, not giving way to priority vehicles, entering the emergency stopping lane...
- Preventing illegal racing and gatherings that disrupt public order; violation when crossing a level crossing; automobilerying beyond the safe waterline mark;
- Vehicles that are not registered, inspected, or do not ensure technical safety;
- Not equipped with life-saving or rescue equipment;
- Not having a driver's license, diploma, or professional certificate; promptly prevent and strictly handle vehicles automobilerying more than the prescribed number of people;
- Coordinating to ensure traffic safety at river-crossing passenger wharves, tourist wharves, waterway routes, and channels, especially passenger transport routes from shore to islands, rivers, and water areas where festivals are held.
Currently, the penalty for alcohol concentration while driving is prescribed in Decree 100/2019/ND-CP (amended in Decree 123/2021/ND-CP), specifically as follows:
