On May 30, 2018, the Government of Vietnam promulgated Decree 85/2018/ND-CP stipulating the standards and norms for the use of automobiles in units of the People's Armed Forces.
Decree 85 outlines specific cases regarding the replacement, arrangement, and disposal of automobiles within the People's Armed Forces as follows:
Cases of automobile replacement:
- Automobiles equipped for leaders in the People's Army and People's Police, who are Members of the Political Bureau, Secretaries of the Central Committee of the Communist Party, and the positions stipulated in point a, clause 2, Article 3 of Decree 85/2018/ND-CP, may be replaced at the request of their work or when meeting one of the specified conditions. The disposal of old automobiles after replacement is carried out in accordance with the Law on Management and Use of Public Assets and Decree 151/2017/ND-CP.- For official title automobiles not mentioned above, general-use automobiles, and common specialized-use automobiles, liquidation is allowed when meeting one of the following conditions:- The usage period has expired according to laws on management, depreciation, and amortization of fixed assets;- Used over 200,000 km in mountainous areas, islands, or areas with particularly difficult socio-economic conditions as regulated by the Government of Vietnam and the Prime Minister of the Government of Vietnam; used over 250,000 km in other areas;- The automobile is damaged beyond repair, or repair is not cost-effective (estimated repair costs exceed 30% of the original price).- Specialized-use automobiles are replaced based on the need to execute professional defense, security tasks, ensuring efficiency and cost savings.
Cases of reorganization and disposal of automobiles:
Based on the standards and quotas for the use of automobiles, the Minister of National Defense and the Minister of Public Security shall direct functional agencies to review and reorganize the current number of automobiles; handle surplus automobiles (if any), and report to the Prime Minister of the Government of Vietnam before June 30, 2019.
In cases where, after the review, units still lack automobiles compared to the set standards, the following actions should be taken:
- Authorities and individuals with power decide to transfer automobiles from units with surplus vehicles after the review;- Authorities and individuals with power decide to allocate assets in the form of automobiles to managing and using units as stipulated by the Law on Management and Use of Public Assets;- Authorities and individuals with power decide to procure automobiles within the scope of the assigned state budget estimates and other legitimate sources of funding as per legal regulations.
Decree 85/2018/ND-CP takes effect from July 15, 2018.
