Relationships between Viet Nam Social Security and local authorities and organizations in implementing social insurance

This is a notable content of Decree No. 89/2020/ND-CP of Vietnam’s Government the functions, duties, power and organizational structure of Viet Nam Social Security, effective from September 20, 2020.

According to Article 9 of Decree No. 89/2020/ND-CP of Vietnam’s Government, responsibilities and relationships of Viet Nam Social Security with local authorities and organizations in implementing social insurance, unemployment insurance, and health insurance policies are prescribed as follows:

1. Take charge and cooperate with regulatory agencies, socio-political organizations, social organizations and other relevant parties in handling problems related to provisions of social, health and unemployment insurance benefits.

2. Coordinate with relevant state agencies in conducting inspections and audits in the fields of social insurance, unemployment insurance, and health insurance upon request; make recommendations to the competent authorities for handling violations of laws and regulations related to social insurance, unemployment insurance, and health insurance.

3. Take the lead and coordinate with state agencies, political-social organizations, and social organizations in conducting information, communication, and dissemination activities on social insurance, unemployment insurance, and health insurance policies and laws. This is done to increase the number of participants and ensure strict compliance with legal provisions regarding social insurance, unemployment insurance, and health insurance. 

4. Coordinate with Departments of Labor, Invalids and Social Affairs, Departments of Health, and other state agencies to propose to the provincial-level People's Committees the development plan for the target of participants in social insurance, unemployment insurance, and health insurance, as well as the development of participants in social insurance, unemployment insurance, and health insurance based on the set plan.

5. Coordinate with Departments of Labor, Invalids and Social Affairs, Departments of Health, and organizations to address issues related to evasion and late payment of social insurance, unemployment insurance, and health insurance contributions; if necessary, report to the provincial-level People's Committee to implement necessary measures to address the issues of evasion and late payment of social insurance, unemployment insurance, and health insurance contributions in order to protect the legitimate rights and interests of employees regarding social insurance, unemployment insurance, and health insurance.

6. Coordinate with Departments of Labor, Invalids and Social Affairs and relevant agencies to report to Viet Nam Social Security for the settlement of social insurance benefits for employees who worked before January đ1, 1995.

7. Receive information from local labor authorities about employment situations in their areas on a six-month basis. Be provided with tax identification numbers of organizations and individuals by tax authorities; provide information annually on the total salary payment as a basis for tax declaration by enterprises or organizations.

8. Request competent local authorities to re-investigate cases of occupational accidents and occupational diseases.

9. Submit regular quarterly, biannual, and annual reports, as well as ad hoc reports, to the provincial-level People's Committee on the implementation of social insurance and health insurance policies, as well as the situation of evasion and late payment of social insurance, unemployment insurance, and health insurance contributions.
