Regulations to Know About Regular Salary Increases for Officials and Public Employees

Duration for regular salary grade increase for officials and public employees: how long is it? Does the duration for regular salary grade increase include the time off for maternity leave policies? These are recent questions that Thu Ky Luat has received quite frequently from our Clients and Members. Thu Ky Luat would like to address this issue as follows:

According to the current regulations in Circular 08/2013/TT-BNV, the period for maintaining the salary level for regular salary increases for officials and public employees is defined as follows:

- For the senior specialist position: After 5 years (complete 60 months) maintaining the salary level in the senior specialist salary scale, if the final salary level in the senior specialist salary scale has not been achieved.

- For ranks and positions requiring an education level of college or higher: After 3 years (complete 36 months) maintaining the salary level in the rank or position if the final salary level in the rank or position has not been achieved.

- For ranks and positions requiring an education level of secondary school or lower and executive staff, service staff: After 2 years (complete 24 months) maintaining the salary level in the rank or position if the final salary level in the rank or position has not been achieved.

According to this Circular, the following periods will be counted towards the period for considering regular salary increases:

- The time off work with full salary according to labor laws;

- The time off work for maternity leave policies according to social insurance laws;

- The time off work due to sickness, labor accidents, occupational diseases receiving social insurance cumulatively up to 6 months (during the period of maintaining the salary level) according to social insurance laws;

- The time authorized to be sent to work as a specialist, to study, intern, work, survey domestically and abroad (including time under policies for spouses per the Government of Vietnam's regulations) but still on the payroll of the agency, unit.

The periods not counted towards regular salary increases include:

- The time off work without salary;

- The time working as a specialist, studying, interning, working, surveying domestically and abroad beyond the period authorized;

- The time suspended from work, detained, and other non-working periods besides those counted towards the regular salary increases mentioned above.

Note: The total uncounted periods for regular salary increases (if any) are rounded to full months. If there are fractional periods, they are calculated as follows: Less than 11 working days (excluding weekends and days off work with full salary per labor laws) is not counted; 11 working days or more is counted as 1 month.
