Regulations on Working Hours and Annual Leave of Teachers at All Levels

Recently, Law Secretary has received numerous questions from Valued Customers and Members regarding the regulations on working hours and annual leave for teachers. Law Secretary would like to address this issue in the following article.

As stipulated in Article 5 of Circular 28/2009/TT-BGDDT, Clause 3 Article 1 of Circular 15/2017/TT-BGDDT, the working time of teachers at various levels is regulated as follows:

- For primary school teachers, the working time during the academic year is 42 weeks, including:

- 35 weeks for teaching and educational activities as per the regulations on the academic year schedule.- 05 weeks for learning and professional development.- 01 week for preparing for the new academic year.- 01 week for summarizing the academic year.

- For secondary and high school teachers, the working time during the academic year is 42 weeks, including:

- 37 weeks for teaching and educational activities as per the regulations on the academic year schedule.- 03 weeks for learning and professional development.- 01 week for preparing for the new academic year.- 01 week for summarizing the academic year.

As regulated in Clause 3, Article 5 of Circular 28/2009/TT-BGDDT and Clause 4, Article 1 of Circular 15/2017/TT-BGDDT, the annual leave time for teachers includes summer vacation, Lunar New Year holiday, semester breaks, and other leaves. Specifically:

- The annual summer vacation for teachers is 02 months (including annual leave as per the Labor Code), with full salary and allowances (if any).

- The time off for the Lunar New Year holiday and semester breaks are as regulated by the Minister of Education and Training.

- Other leaves as regulated by the Labor Code.

Based on the academic year plan, scale, characteristics, and specific conditions of each school, the Principal shall arrange the annual leave for teachers appropriately.
