Regulations on vehicle registration authorities in Vietnam from January 1, 2025

The article below will detail the regulations regarding vehicle registration authorities in Vietnam from January 1, 2025, according to Circular 79/2024/TT-BCA issued by the Minister of Public Security.

On November 15, 2024, the Minister of Public Security of Vietnam promulgated Circular 79/2024/TT-BCA regulating the issuance and revocation of vehicle registration certificates and license plates for motor vehicles and specialized motor vehicles.

Regulations on vehicle registration authorities in Vietnam from January 1, 2025

Article 4 of Circular 79/2024/TT-BCA provides regulations on the vehicle registration authority effective from January 01, 2025, as follows:

(1) The Traffic Police Department registers the vehicles of units under the Ministry of Public Security; automobiles, specialized motor vehicles of agencies and organizations specified in Appendix No. 01 issued with Circular 79/2024/TT-BCA; automobiles of diplomatic missions, international organizations with headquarters in Hanoi and automobiles of foreigners working at those agencies.

(2) The Traffic Police Division registers the following types of vehicles (except those specified in (1)):

- Automobiles, trailers, semi-trailers, four-wheeled passenger vehicles with engines, four-wheeled goods vehicles with engines, vehicles structurally similar to automobiles (hereinafter referred to as automobiles) and specialized motor vehicles of organizations, individuals with headquarters or residence in districts, cities under centrally governed cities or in cities or district-level towns of the province where the Traffic Police Division is headquartered;

- Automobiles registered with winning auction plates; motorcycles registered with winning auction plates for plates managed by the Traffic Police Division.

- Vehicles of confiscated origin, motorcycles with a cylinder capacity of 175 cm3 or more;

- Automobiles, specialized motor vehicles, motorcycles, mopeds, and vehicles structurally similar to motorcycles (hereinafter referred to as motorcycles) of foreign organizations, individuals.

(3) District-level police register types of vehicles: Motorcycles registered with winning auction plates; automobiles, specialized motor vehicles, motorcycles of domestic organizations, individuals with headquarters or residence locally (except those specified in (1), (2), (4)).

(4) Commune police, ward, and commune-level town (hereinafter referred to as commune-level police) conduct motorcycle registration (except for vehicles of confiscated origin, vehicles with a cylinder capacity of 175 cm3 or more, and vehicles registered with winning auction plates) as follows:

- Commune-level police in districts, district-level towns under centrally governed cities register motorcycles of domestic organizations, individuals with headquarters or residence locally;

- Commune-level police in districts, district-level towns, cities within the province (excluding commune-level police where Traffic Police Division, district-level police, district-level town, city headquarters are located) with a registration count of 150 or more vehicles/year (average over the last 3 years) conduct motorcycle registration for domestic organizations, individuals with headquarters or residence locally.

(5) For special localities, based on the actual situation of registration volume, locality characteristics, geographic distances, the Director of Provincial Public Security shall agree with the Traffic Police Department to decide to organize vehicle registration as follows:

- For commune-level with newly registered motorcycles less than 150 vehicles/year, assign that commune-level police to register vehicles directly or assign district-level police, district-level towns, cities, or commune-level police already delegated to organize registration by cluster;

- For commune-level areas with a registration volume exceeding capacity, in addition to direct registration by that commune-level police, assign district-level police, district-level towns, cities, adjoining commune-level police already delegated to support organizing registration by cluster for domestic organizations, individuals with headquarters, residence locally.

(6) The vehicle registration authority is responsible for ensuring physical facilities and arranging convenient locations for receiving and processing vehicle registration documents. The registration site must have a directional diagram, working hours, officer title signs, seating, parking, complaint boxes, and publicly displayed vehicle registration procedures and fees.

Responsibilities of vehicle registration authorities and officers from January 01, 2025

According to Article 5 of Circular 79/2024/TT-BCA, the vehicle registration authorities and officers are required to have the following responsibilities:

- The vehicle registration authority must organize the receiving of vehicle registration applications on working days throughout the week. If necessary, the Provincial Public Security Director will decide and publicly announce the organization of receiving registrations outside working hours, on weekends, and holidays. Arrange vehicle registration officers to regularly check the vehicle registration and management system, receive documents to ensure timely registration resolution according to regulations.

- Receive and check vehicle documents, inspect the actual vehicle, engrave engine and chassis numbers, and digitize vehicle documents onto the registration and management system.

- If vehicle documents and electronic data conform with regulations, proceed with the registration. If not compliant with regulations, provide specific, complete instructions, record guidance content on the instruction sheet and be accountable for that guidance.

- During the process, registration officers must strictly adhere to the People's Police regulations, have proper conduct, and respect the public.

Comply with the regulations of Circular 79/2024/TT-BCA and other related laws concerning vehicle registration work. Do not require additional registration procedures that contravene those defined in Circular 79/2024/TT-BCA.
