Regulations on the Scope and Areas of Immigration Control from August 15, 2020

On July 1, 2020, the Ministry of Public Security issued Circular 74/2020/TT-BCA stipulating the regulation of entry and exit controls for Vietnamese citizens at border gates.

Circular 74/2020/TT-BCA applies to Vietnamese citizens exiting and entering the country; border control units at land border gates, port border gates, and airport border gates; relevant agencies, organizations, and individuals. Clause 3 of Article 4 stipulates the scope, border control area, specifically:

- The scope and border control area at airport border gates are counted from the area where passengers queue for immigration procedures to the aircraft gate and from the aircraft gate to the immigration control desk.

- The scope and border control area at land border gates include the scope of the land border gate area determined according to the provisions of Decree No. 112/2014/ND-CP dated November 21, 2014, of the Government of Vietnam on the management of land border gates.

- The scope and border control area at port border gates include:

- The scope of seaports, jetties, docks, and offshore oil ports opened by the Ministry of Transport or the Vietnam Maritime Administration under the authority prescribed by law for Vietnamese and foreign vessels to arrive, depart, load, and unload goods, embark and disembark passengers, and conduct other activities; the scope of inland waterway ports, inland waterway jetties, and fishing ports within the water area of seaports.- The scope of inland waterway ports, inland waterway jetties opened by the Ministry of Transport or the Vietnam Inland Waterways Administration or the Department of Transport of provinces and centrally-run cities under the authority prescribed by law for Vietnamese and foreign vessels to enter, exit, transfer ports for loading and unloading goods, embark and disembark passengers, and conduct other activities; the scope of inland waterway jetties with the water area in front of docks belonging to the water area of inland waterway port border gates.
