Regulations on the road safely corridor in Vietnam according to the Law on Road 2024

Recently, Hanoi has passed the Law on Road 2024, which includes regulations on the road safety corridor in Vietnam.

On June 27, 2024, Hanoi passed the Law on Road 2024 which include regulations on the classification of roads in Vietnam.

Regulations on the road safely corridor according to the Law on Road 2024

The road safely corridor is regulated as follows:

(1) The width of the road safely corridor is determined according to the following principles:

- For roads outside the urban area, it is determined from the outer edge of the land used for protecting and maintaining the road, according to the scale, and technical level of the road; in the case where the existing road has not yet been identified for technical level, the width of the road surface and the road design standards are used to determine the corresponding technical level as the basis for determining the width of the road safely corridor;

- For urban roads, it is determined from the outer edge of the land used to protect and maintain urban roads to the red line boundary but not exceeding the width of the road safely corridor for roads outside the urban area of the same level;

- For bridges, ferries, and pontoon bridges, it is determined according to the length, and width of the structures, and depends on the river level and the scale of the structures; for viaducts and overpasses, it is determined from the outer edge of the land used to protect and maintain the bridge;

- For tunnels, it is determined from the outer edge of the land protecting the tunnel structures around it;

- Roads with embankments, protective retaining walls within the land reserved for road infrastructure structures are determined from the outer edge of the embankment, the protective retaining walls outward but not exceeding the width of the road safely corridor as stipulated above;

- For village roads, alleys, and narrow streets in urban areas and other roads not allowing automobile movement, it is not mandatory to arrange a road safely corridor.

(2) For roads with a safety corridor overlapping other structures, they are delineated according to the following principles:

- Roads with a road safely corridor overlapping the railway safety corridor prioritize the allocation of the safety corridor for railways. The management, and use of the railway safety corridor shall not affect the quality of road structures and road traffic safety;

- Roads with a road safely corridor overlapping the inland waterway protection corridor shall not affect the quality of the structures and traffic safety;

- Roads coexisting with dikes or having a road safely corridor overlapping the dike protection corridor give priority to the allocation of the dike protection corridor; in cases where the road safely corridor is larger than the dike protection corridor, it follows the road safely corridor dimensions;

- At overlapping, and intersecting sections, the road safely corridor is determined according to the road with higher technical standards; adjacent roads, the road safely corridor is determined according to the outermost road.

(3) The identification and management of road safely corridor boundary markers are regulated as follows:

- road safely corridor boundary markers are determined according to the scale, technical level, alignment, and scope of road structures;

- The investor in road construction is responsible for organizing the planting of road safely corridor boundary markers within the investment project scope; handing over to the road management agency, the person managing, and using the road;

- The road management agency, the person managing, and using the road is responsible for publicly announcing the road safely corridor boundary markers; adjusting, and supplementing the road safely corridor boundary markers during the management, operation, exploitation, and maintenance of road structures;

- The road management agency, the person managing, using the road, and People's Committees at all levels are responsible for managing road safely corridor boundary markers according to the provisions of the Law on Road 2024, land law, and other related legal provisions.

Management and use of land for road safely corridor in Vietnam

According to Article 16 Law on Road 2024, regulations on the management, and use of land for road safely corridor in Vietnam are as follows:

- The land in the road safely corridor that has been reclaimed by the State must be managed, and used according to the provisions of the Law on Road 2024, land law, public asset management law, and other related legal provisions.

- (*) The use of land in the road safely corridor must comply with the following regulations:

+ Ensure the safety of road structures and other structures within the road safely corridor;

+ Do not obscure road signs, do not affect the driver's vision, ensure road traffic order and safety;

+ Protect the landscape and environment according to legal regulations.

- Land in the road safely corridor not yet reclaimed by the State can continue to be used according to the Land Law 2024 and comply with the regulations in section (*).

- The planting, care, and exploitation of trees in the road safely corridor must comply with the regulations in section (*) and the following regulations:

+ Implement necessary measures to avoid the risk of tree breakage, falling, causing danger to road traffic participants; causing damage to road structures and adjacent structures;

+ Trim when trees obscure road signs, block the view of road traffic participants, and affect road traffic safety;

+ Do not affect the quality and maintenance activities of the road.

- The use of land in road safely corridors overlapping the dyke protection area, areas adjacent to hydraulic structure, and the railway protection corridor must comply with the Dyke Law 2006, Hydraulics Law 2017, Railway Law 2017, Land Law 2024, Law on Road 2024 and other related legal provisions.

- Service roads must be constructed outside the road safely corridor unless the service road simultaneously acts as the lateral road.

In cases where it is not possible to arrange the service road outside the road safely corridor, it can be arranged within the road safely corridor, but must meet the following conditions:

+ The remaining width of the road safely corridor is sufficient for road expansion according to the plan;

+ Ensure the safety of road structures;

+ Ensure road traffic safety and clear vision for vehicles.
