Regulations on the responsibilities of mobile telecommunications enterprises in Vietnam from December 25, 2024

In Article 75 of Decree 147/2024/ND-CP, the responsibilities of mobile telecommunications enterprises in Vietnam from December 25, 2024, are stipulated as follows:

(1) Conduct business cooperation with organizations and enterprises providing information content services on mobile telecommunications networks based on the following principles:

- Through negotiation, ensuring fairness, reasonableness, and respecting the rights and interests of the participating parties;

- Efficient use of telecommunications resources and telecommunications infrastructure;

- Ensure the safe and unified operation of telecommunications networks;

- Ensure the legitimate rights and interests of telecommunications service users and relevant organizations/individuals; ensure confidentiality of user information as per legal regulations;

- Provide connectivity for organizations, enterprises offering information content services on mobile telecommunications networks in technical terms, ensure connectivity promptly, reasonably, openly, transparently;

- Non-discrimination in terms of connectivity, tariffs, payment, telecommunications technical standards, network and service quality.

(2) Be responsible for controlling the process and system of services provided by organizations and enterprises offering content services on mobile telecommunications networks, ensuring that registration, authentication, refusal, renewal, service cancellation, fee collection, and notification to service users comply with relevant legal conformable.

(3) Be responsible for ensuring connectivity only for providing services with content services conformable with relevant legal regulations.

(4) Temporarily suspend, cease connectivity, or refuse connectivity with enterprises providing information content services on mobile telecommunications networks in the following cases:

- The mobile telecommunications enterprise detects or confirms information reflecting content, services violating the provisions of Article 8 of the Cybersecurity Law;

- There is a request in writing, by phone, or electronically from the Ministry of Information and Communications of Vietnam (Telecommunications Department), Ministry of Public Security of Vietnam (Department of Cybersecurity and High-Tech Crime Prevention). The latest execution time is within 24 hours from the receipt of the request;

- There is a decision to suspend connection activities to provide information content services on mobile telecommunications networks, a decision to revoke the connection registration certificate according to this Decree's provisions or a decision to revoke or notify acceptance of telecommunications code/number refund according to telecommunications legal regulations;

- Organizations, enterprises providing information content services on mobile telecommunications networks do not have or their certificates have expired.

(5) Mobile telecommunications enterprises agree on using codes, telecommunications numbers suitable for number inventory planning so that service users can query information about the information content services being used. Information provided to users includes: Service name; code, telecommunications number providing the service; fee cycle; tariff; how to cancel the service.

(6) Send a notice to subscribers on the 25th of each month to inform users about the content services they are using (including information: Service name; subscribed service package; service tariff) via SMS or other methods as decided by the Ministry of Information and Communications of Vietnam.

(7) Coordinate with organizations, enterprises providing information content services on mobile telecommunications networks to resolve complaints, disputes regarding fees, and service quality for users as prescribed in Article 76 of Decree 147/2024/ND-CP.

(8) Implement policies for periodic and ad-hoc reporting and statistics as prescribed in Article 77 of Decree 147/2024/ND-CP and comply with inspection and examination by the Ministry of Information and Communications of Vietnam and competent authorities.
