Regulations on the procedures for land inspection nationwide in Vietnam from August 1, 2024

According to Article 13 of Circular 08/2024/BTNMT, the procedures for land inspection nationwide in Vietnam from August 1, 2024 are stipulated as follows:

- Preparatory work:

+ Develop documents directing the provincial People's Committee to conduct land inspections;

+ Develop a plan for conducting land inspections and professional guidance documents (if any);

+ Organize professional training for the provincial People's Committee and related agencies;

+ Collect records, materials, maps, and related data during the land inspection period, national land use planning and plans; previous land inspection results, annual land statistics during the national land inspection period, and other related materials.

- Guide, inspect, and urge the implementation of land inspection nationwide.

- Receive the results of the military land inspections from the Ministry of National Defense, security land inspections from the Ministry of Public Security; receive results of provincial land inspections and direct amendments, completion of data, and report land inspection results (if any).

- Process and compile national land inspection data; prepare forms specified in points a, b, c, d, and dd clause 1 of Article 5 of Circular 08/2024/BTNMT and compile explanatory reports on current land use according to the regulations in clause 6 of Article 10 of Circular 08/2024/BTNMT.

- Prepare current land use maps, compile explanatory reports on the nationwide current land use maps according to the regulations in Articles 16, 17, 18, 19 of Circular 08/2024/BTNMT.

- Prepare national land inspection results reports with main contents:

+ Situation of organizing and implementing the national land inspections;

+ Analysis and evaluation of current land use; analysis of causes of fluctuations in land use between the land inspection year and the figures of the 02 most recent land inspection periods; situation of inconsistency regarding provincial administrative boundary lines during the land inspection period (if any);

+ Propose and recommend measures to improve the efficiency of land management and use.

- Inspect and accept the results of the nationwide land inspections.

- Finalize and report to the Prime Minister of the Government of Vietnam on the nationwide land inspection results.

- Print and publish the land inspection results according to the regulations in clause 4 and point c of clause 5 of Article 23 of Circular 08/2024/BTNMT.

Regulations on the inspection of land statistics and inspection results in Vietnam

- Inspection contents include:

+ The completeness of materials and data in the records of land statistics and inspection results;

+ The completeness and accuracy of delineating land plots and determining land types, types of land users, and subjects assigned to manage land on the commune land inspection result;

+ The completeness and accuracy in aggregating land plots in the list of land plots during the statistical and inspection period compared to the land inspection result and the list of cases of land changes during the statistical and inspection period reviewed and confirmed by the commune People's Committee;

+ The accuracy in aggregating data in the statistical and inspection tables on land;

+ The consistency of data among the statistical and inspection tables on land with the land inspection result of the commune level; among the statistical and inspection data tables of different levels; tables of data with land statistics and inspection results reports;

+ The quality of land statistics and inspection result reports at different levels must ensure completeness according to the regulations in clause 5 of Article 6, clause 7 of Article 7, clause 7 of Article 8, clause 5 of Article 9, clause 8 of Article 10, clause 8 of Article 11, clause 9 of Article 12, and clause 6 of Article 13 of Circular 08/2024/BTNMT;

+ The quality of land use maps at different levels and the commune level land inspection result ensuring accuracy and completeness according to the regulations in Articles 16, 17, 18, and 20 of Circular 08/2024/BTNMT.

- Responsibilities for inspecting land statistics and inspection results:

+ Organizations and individuals directly conducting land statistics and inspections must self-check and take responsibility for the results during implementation;

+ The commune People's Committee must self-check and approve the commune-level land statistics and inspection results;

+ The district-level land management authorities must check the commune-level land statistics and inspection results, self-check and submit to the district People's Committee for approval of the district-level land statistics and inspection results;

+ The provincial-level land management authorities must check the district-level land statistics and inspection results, self-check and submit to the provincial People's Committee for approval of the provincial-level land statistics and inspection results;

+ The agency advising the Minister of Natural Resources and Environment on state management of land statistics and inspections must check the military land statistics and security land inspection results of the Ministry of National Defense and the Ministry of Public Security, check the provincial land statistics and inspection results.

- The inspection and acceptance of land statistics and inspection projects and products are carried out according to the regulations of the Ministry of Natural Resources and Environment on inspection, assessment, and acceptance of projects and products in the field of land management.
